Chair Robert Murphy recused himself because he has occasional business dealings <br />� with the appl�cant stemming from his position on the board of another residential community <br />� de�eloped by the applicant for this variance reque�t, <br />� and the following members were absent: None <br />� Variance Board Member Boguszewski introduced the follawing resolution and maved its <br />� �s adoption: <br />11 <br />VB RESOLUTIQN NO. 120 <br />�2 A RESO�UTIQN APPROVING A VARIA�CE T4 �1004.06.H, SURFACE PARKING, <br />�:< OF THE ROSEVILLE CITY C+QDE A'�' 934 WOODHILL DRIVE <br />�4 FOR UNITED PROPERTIES RESIDENTIAL, LLC (PF16-D09) <br />�� WHEREAS, City Code S� 004.06.H, Surtace Parkin�;, does not allaw surface paricing <br />�� between the front of the building and the prirnary street exce�t for handicapped stalls; and <br />�� WHEREAS, �ity Code § 1004.Q6.H, �urface Parking, limits surface parking to no greater <br />� s than 40°./0 of the primary street lot frontage; and <br />�� WHEREAS, United Properties Residential, LLC (U�) seeks to construct Applewoad <br />2�� Poinie of Rosevill� at Central Park on the subject pr4perty, which includes a surface parking lot <br />z� between the building anci primary street; and <br />�� WHEREAS, the subject property is legaliy described as: <br />23 Lot 1, Black 1, Applewood Pointe of Roseville at Central Park <br />�-� WHEREAS, City Code § 1009.44 (Variances} est�blishes tl�e purpose of a VAftIANCE is <br />2� "to permit adjustment to the zaning reguIations where there are practical difficulties applying tc� a <br />2� parce] of land or building that prevent the property from being used to the extent intended by the <br />z7 zaning;" and <br />z8 WH�R�A5, the Variance Board has made the follawing findings: <br />z�; a. The cc�de-compliant manner in �vhich to meet the requ�rements of � l 004.�b.H, <br />:�o Surface Parking, has been determined ta be burdensorne foX ik�is situation.
