Regular Planning Commission Meeting <br />Minutes – Wednesday, April 6, 2016 <br />Page 17 <br />Chair Boguszewski noted that the only problem is that raised by Mayor Roe and his concern in <br />801 <br />avoiding future confusion with what “approximately” meant. <br />802 <br />Member Gitzen opined that, in this situation, it meant “reasonable,” while admitting he wasn’t <br />803 <br />clear on Mayor Roe’s intent, but concurred with staff’s approach being more reasonable by <br />804 <br />inserting the word “approximately.” <br />805 <br />In responding further to Member Daire’s comments related to using parallel lot lines, Mr. Lloyd <br />806 <br />displayed the city map and another example problem area and how lot lines may or may not be <br />807 <br />subdivided to make them parallel. <br />808 <br />Member Gitzen noted problems on cul-de-sacs and adjacent lots as well. <br />809 <br />Mr. Lloyd opined that if terms are to be understood as rigid as written and not allow for some <br />810 <br />flexibility, there needed to be some place for reasonable interpretation and application, and not <br />811 <br />necessarily just parallel. <br />812 <br />Member Murphy enforced the comments of Mr. Lloyd, using the Ferriswood and Ferris Lane area <br />813 <br />as an example where no parallel lines were possible; and further supporting the flexibility <br />814 <br />provided by adding the word “approximately.” <br />815 <br />If the body decides to move this tonight, Chair Boguszewski recognized that staff’s suggestion to <br />816 <br />add “approximately” remain in the revised text, with the meeting minutes reflecting that the <br />817 <br />Planning Commission deliberated this for some time, but in the end decided to retain the <br />818 <br />proposed text revision. As part of that record, Chair Boguszewski suggested that Mr. Lloyd’s well- <br />819 <br />stated summation also be reiterated in that subsequent staff report justifying the retention of the <br />820 <br />word “approximately” as noted. <br />821 <br />Regarding the other proposed revisions and variables between that suggested by staff compared <br />822 <br />with Mayor Roe’s submission, Mr. Lloyd noted that with the noted exception, staff was fine in <br />823 <br />using Mayor Roe’s revisions since it may be addressed accordingly at the City Council level as <br />824 <br />well, no matter the Commission’s recommendation. <br />825 <br />Chair Boguszewski asked if there was a more efficient way to point to another definition and <br />826 <br />formatting changes as required. <br />827 <br />Mr. Lloyd responded that if the Commission takes action tonight related to lot standards and <br />828 <br />sizes, he suggested referencing Mayor Roe’s revisions in lines 2 through 14 of the bench <br />829 <br />handout; with staff redrafting the document and applicable heading changes for submission to the <br />830 <br />City Council. <br />831 <br />Chair Boguszewski and Member Gitzen asked if there was any urgency in acting on this tonight; <br />832 <br />or if staff could bring it back to us reformatted and including tonight’s discussion and those of <br />833 <br />Mayor Roe’s suggestions as indicated. <br />834 <br />Staff advised there was no critical urgency and supported the commission’s request. <br />835 <br />Recognizing this requires a public hearing, Chair Boguszewski invited public comment at this <br />836 <br />time; with no one appearing to comment, Chair Boguszewski deferred the public hearing until the <br />837 <br />next meeting. <br />838 <br />MOTION <br />839 <br />Member Cunningham moved, seconded by Member Gitzen to TABLE this item to the next <br />840 <br />Planning Commission for later review and consideration of a more precise document. <br />841 <br />Ayes: 7 <br />842 <br />Nays: 0 <br />843 <br />Motion carried <br />844 <br />8.
