Unfinished Business – Public Hearings Closed: Items Previously Tabled <br />100 <br />Chair Boguszewski reviewed the protocol for public hearings and subsequent process. <br />101 <br />a. PLANNING FILE 16-007 <br />102 <br />Request by Vogel Mechanical for a CONDITIONAL USE to allow limited production <br />103 <br />and processing at 2830 Fairview Avenue <br />104 <br />C <br />hair Boguszewski noted that the Public Hearing for Planning File 16-007 had been <br />105 <br />closed after public comment at the March 2, 2016 meeting. Chair Boguszewski further <br />106 <br />noted that the decision to TABLE this item had been made after deliberation by the <br />107 <br />Commission, with a motion and several amendments that had been enacted by the body. <br />108 <br />At the time, Chair Boguszewski noted that the Commission determined that several areas <br />109 <br />identified during those deliberations remained uncertain (as per the language of the <br />110 <br />motion noted below) and the item was tabled pending discovery of that information. <br />111 <br />MOTION <br />112 <br />Member Boguszewski moved, seconded by Member Stellmach to TABLE consideration <br />113 <br />of this item to the next meeting of the Planning Commission (April 6, 2016); pending <br />114 <br />discovery and information represented in areas identified tonight and uncertain to the <br />115 <br />Commission in areas as noted, including the nature of the easement and whether it is <br />116 <br />feasible to place the fence along the northern edge of the property or where the fence <br />117 <br />could be placed closest to the northern edge of the property line. <br />118 <br />Ayes: 4 (Stellmach, Cunningham, Boguszewski, Gitzen) <br />119 <br />Nays: 3 (Murphy, Daire, Bull) <br />120 <br />Motion carried <br />121 <br />Therefore, Chair Boguszewski stated tonight’s consideration of this item would be <br />122 <br />pursued from that point forward and that the Commission would not be taking any <br />123 <br />additional public comment tonight, but simply continue deliberation among <br />124 <br />Commissioners. Chair Boguszewski advised his colleagues that the appropriate action at <br />125 <br />this time would be for a motion to take this item from its tabled status; also noting that <br />126 <br />such action required a majority vote of the body. <br />127 <br />MOTION <br />128 <br />Member Bull moved, seconded by Member Cunningham to TAKE FROM THE <br />129 <br />TABLE Planning Case PF16-007 <br />130 <br />Ayes: 7 <br />131 <br />Nays: 0 <br />132 <br />Motion carried. <br />133 <br />At the request of Chair Boguszewski, Interim Community Development Director Kari <br />134 <br />Collins restated the motion and conditions from the March 2, 2016 Planning Commission <br />135 <br />meeting, immediately prior to it being tabled. <br />136 <br />ORIGINAL MOTION Restated as Amended <br />137 <br />Member Daire moved, seconded by Member Murphy to recommend to the City Council <br />138 <br />approval of a CONDITIONAL USE allowing limited production and processing as an <br />139 <br />accessory use at 2830 Fairview Avenue, based on the comments and findings contained, <br />140 <br />and subject to stated conditions for approval as detailed in the staff report dated March 2, <br />141 <br />2016; amended as follows: <br />142 <br /> <br />
