<br />REQUEST FOR CITY COUNCIL ACTION <br />05/23/2016 <br /> Agenda Date: <br /> Agenda Item: 8.e <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Termination of Planned Unit Development (PUD) Agreement 1385, <br />approved by the Roseville City Council on July 13, 2009. <br /> <br /> <br />RB <br />Њ <br />EQUEST AND ACKGROUND <br />Recently Wellington Management has contacted the City seeking a termination of the former <br />Ћ <br />PUD that is recorded against 2167 Lexington Avenue and 1126 Sandhurst Avenue so that they <br />Ќ <br />can complete the sale of the Lexington addressed property to the current tenant. <br />Ѝ <br />On July 13, 2009, the City Council approved Roseville Crossings LLC (Wellington <br />Ў <br />Management) request for a planned unit development on the former Twin Cities Federal (TCF) <br />Џ <br />site at 2167 Lexington Avenue and for the property at 1126 Sandhurst Drive. <br />А <br />PUD Agreement 1385 was recorded against the property on August 12, 2009 and on July 11, <br />Б <br />2010, the City Council approved an extension to the development deadline established in PUD <br />В <br />1385 to allow an additional year to commence development. Below are the four conditions <br />ЊЉ <br />approved as a component of the PUD amendment: <br />ЊЊ <br /> <br />1.The Developer is hereby given an additional one year to commence the development <br />ЊЋ <br />activity required under the Agreement. <br />ЊЌ <br /> <br />2.Section 4.5 of the Agreement is hereby amended to read as follows: <br />ЊЍ <br /> Failure by the DEVELOPER to commence development activity in accordance with the <br />ЊЎ <br />final development plans or within two years following the final approval of this PUD will <br />ЊЏ <br />necessitate the approval of an extension of the development schedule by the City Council <br />ЊА <br />prior to the expiration of the two year period. If an extension is not applied for, the <br />ЊБ <br />Council may instruct the Planning Commission to initiate rezoning to the least intensive <br />ЊВ <br />zoning district consistent with the land use designation of the Comprehensive Plan. For <br />ЋЉ <br />purposes of this provision, development activity shall be defined as obtaining a building <br />ЋЊ <br />permit and beginning construction on the site. <br />ЋЋ <br /> <br />3.The parties reaffirm the Agreement as hereby amended, and agree that except as <br />ЋЌ <br />amended, all other terms and conditions of the Agreement shall remain the same. <br />ЋЍ <br /> <br />4.The Developer agrees to pay all costs incurred by the City in recording this Agreement <br />ЋЎ <br />with the Ramsey County Recorder and/or Registrar of Titles. <br />ЋЏ <br />In the ensuing years after the PUD was approved a number of factors led to the demise of the <br />ЋА <br />proposed redevelopment project.
