EXTRsaCT OF NiINUTES OF MEETING OF THE <br />VARIANCE BO�RD OF TH� �CITY �F ROSEVILLE <br />Pursuant ta due call and notice thereof, a public hearing was held at the regular meeting of the <br />Variance Board of the City of Raseville, County of Rarr�sey, Minnesata, on the 13`h day of Juiy <br />2016, at 5;3(} p.m, <br />T'he follou•in�� rnembers were present: Chair Robert Murphy, Members James Daire and <br />Chuck Gitzen; <br />and none were absent. <br />Variance Baard Mernber Gitzen intraduc�d tne followin� resolution and moved its adoption: <br />�'B RES4LUTIaN NO. 1�2 <br />.�, RESOLUTIO� .-�PPRO�'I':1G Val2I.�tiCES TO RC?SE�'ILLE CITY CODE SECTIOti <br />1D0�.08 :�T 2006 C�HArSEY BOULEVA,RD (P�16-Oi7) <br />WHEREAS, the subject �roperty is assi�ned Ramsey County Parcel [denti�cation <br />Nurnber 13-29-23-24-Qfl4�, and is le�ally descr�bed as: Lot 18, Block 4, McCarron's Addition, <br />Ramsey County, Minnesota; and <br />VVHEREAS, City Code y lOd�.08 requires principal structures to be set back a minimum <br />of 30 feet from front and rear property lines and further requires front porches to b� �et back a <br />minimum of 22 feet from �ront p�-operty lines; anci <br />WHEREAS, the o��n�r of the subjeet property has requested a variance to this section of <br />the City Code to allow a proposed new horne to encroach approximately 8 feet into the required <br />rear yard and approxi�ately �3 feet into the required front yard, equa! to the foundation of the <br />orrginal home on the property, and to allow a front porch to encroach appraximately 7 feet into <br />the re�uired front porch setback; and <br />WHEREAS, City Code � 1009.44 (Variances) establisi�es that the purpose af a ti°ariance is <br />"to permit adjustment to the zoning re�ulations where ther� are practicai difficulties applying to a <br />parcel of land or buildin� that prevent the property from being used to t�e extent intended 5y the <br />zaning;"' and <br />WHEREAS, the Variance Board has made the followin� findin�s: <br />a. The praetical difficulty is created by the unusual lot shape and the fact that th� <br />existing foundation occupres the largest part of the buildable space between the <br />setback lines, the combination of w�t�ich eith�r forces a new� hot�e intfl the smaller part <br />of the lot or adds signi�cant excawatian and engineering expense to make fc�rmer <br />hause location suitable for redevelopment if the existin� four�dation is not reused. <br />b.
