RVBA Attachment D <br />EXTRACT OF MINUTES OF MEETING OF THE <br />VARIANCE BOARDOF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a public hearing was held at theregular meeting of the <br />1 <br />th <br />Variance Board of the City of Roseville, County of Ramsey, Minnesota, on the 14 day of <br />2 <br />September 2016, at 5:30 p.m. <br />3 <br />The following members were present:_______; <br />4 <br />and ______ wereabsent. <br />5 <br />Variance Board Member _________ introduced the following resolution and moved its adoption: <br />6 <br />VB RESOLUTION NO. ___ <br />7 <br />A RESOLUTION APPROVING VARIANCESTO ROSEVILLE CITY CODE SECTION <br />8 <br />1017.16 AND 1017.26AT 1204 BROOKS AVENUE(PF16-025) <br />9 <br />WHEREAS, the subject property is assigned Ramsey County Parcel Identification <br />10 <br />Number 10-29-23-14-0076, and is legally described asLot 2, Block 7 PortePark No. 2, Ramsey <br />11 <br />County, Minnesota; and <br />12 <br />WHEREAS, City Code §1017.16 requires a minimum principal structure setback of 75 <br />13 <br />feet from the Ordinary High Water Level (OHWL)of Willow Pond; and <br />14 <br />WHEREAS, the City of Roseville has received a valid request for a variance to this <br />15 <br />section of the City Code to allow a, 8’ x 22’ porch roof attached to the principal structure to stand <br />16 <br />as close as 40 feet fromthe Willow Pond OHWL; and <br />17 <br />WHEREAS, City Code §1017.26 limits impervious surfaces on shoreland properties to <br />18 <br />25% of the parcel area above OHWL; and <br />19 <br />WHEREAS, the City of Roseville has received a valid request for a varianceto this <br />20 <br />section of the City Code to allow a future driveway expansion that could increase impervious <br />21 <br />surfaces to as much as 27% of the parcel area above OHWL; and <br />22 <br />WHEREAS, City Code §1009.04 (Variances) establishes that the purpose of a varianceis <br />23 <br />β€œto permit adjustment to the zoning regulations where there are practical difficulties applying to a <br />24 <br />parcel of land or building that prevent the property from being used to the extent intended by the <br />25 <br />zoning;” and <br />26 <br />WHEREAS,the Variance Boardhas made the following findings: <br />27 <br />a. <br />The practical difficultiesin this case exist because the legal, nonconforming setback <br />28 <br />of the existing house from the OHWL makes it impossible to adequately shelter the <br />29 <br />existing walkout stairwell from rain without further encroaching into the required <br />30 <br />setback. <br />31 <br />Page 1 of 3 <br />Page 1 of 3 <br /> <br />
