EXTRACT OF 1VIINUTES OF MEE'�`�NG OF THE <br />VARIANCE BOA�D QF THE CITY OF �OSEVILLE <br />Pursuant to due call and notice thereaf, a regular meeting of the City Council of <br />the City° af Rose��ille, County of Ramsey, Minnesota, �vas held an the 2�d da}� of <br />No��ember at �:3o p.m. <br />'�`l�e following 1Vletnbers were present: Chuck Gitzen, James Daire and Chair <br />Robert �Vlurphy; <br />and non� were absent. <br />Varian�e Board IViember Daire introduced the following resolution and �noved its <br />adoption: <br />VARIANCE BOARD RESOLUTION NO. �26 <br />A RESOLUTION APPROVING A VARIANCE TO §iaii.o8 {FENCES IN ALL <br />DISTRICTS) OF THE ROSEVILLE CITY CODE AT <br />280o MQLTNT RIDG� ROAD {PFi6-v29} <br />WHERF�S, City Code §ioil.o8 (�'ences in All Districts) establishes fencing <br />requirements for all yard areas, including the front yard whe�e fences are allowed to a <br />maximum of four feet in height; and <br />WHEREAS, Caly�ct Inc., property ov��ner of 2$001Vlount Ridge Road, requests a <br />V�zl��'c� t� §�ou.o8 (Fences in All Districts} ta allo��� the installation af a six faot tall <br />security fence in the front }tard area adjacent to Mount Ridge Road; and <br />WHEREA�, the praperty at 280o Mount Ridge Road is legally described as {see <br />attached legal description). <br />PID # o4.2g.23.32,00i5 <br />WHEREAS, �it}� Code §ioog.o� (Varianees) establishes the purpose of a variance <br />is "to perrr�it adjustment to the zonir�g regulations �vhere there are praetical difficuPties <br />applti�ing to a parcel of land or building that prevent the propert}� from being used to th� <br />e�ent intended by the zoning;" and <br />WHEREAS, the Variance Board has made the fo�lowing findings: <br />a. �i"'he proposal is corzsistent with the Comprehensive �dan. Although such <br />impro�-�ments are not specifically identified in the 203o Rose�-ille <br />Comprehensive Plan, �'lanning Di`�isian staff finds that the propc,sed fence <br />improvement is generally consistent vwith the Comprehensive Plan <br />(Com�mercial Goals and Palici�s) in that it represents in���stment in an <br />existing commercial proper�y, achieves efficient use of the land, and ensures a <br />creatiw=e aesthetic character. <br />b. The proposal fs in har•mony with the purposes and intent of the zoning <br />ordznances. Planning Di��ision finds that the installation o� a fence two feet <br />ta�ler than the current Cade requirement (four to six feet in height) generall�� <br />satisfies the intent and purpose of the Zo�ning Code.
