Request For Planning Commission Action Agenda Date: 11/02/16 <br />Public Hearings Agenda Item: 5a <br />Item Description: Continuation of the public hearing to consider Text Amendments <br />to Employment Districts, Chapter 1006, and Section 1009, <br />Procedures, to include motor freight terminal as a conditional use. <br />Background <br />Њ <br />On October 5, 2016, the Planning Commission tabled consideration of the subject <br />Ћ <br />Planning Division request after concerns were expressed by the public around the motor <br />Ќ <br />freight terminal definition, and the interpretation of principal uses. Although staff <br />Ѝ <br />agrees that future consideration of additional text amendments concerning motor <br />Ў <br />freight terminal, trucks, and auto oriented uses are necessary, such amendments would <br />Џ <br />need to be properly vetted by City staff and a separate hearing published and held by the <br />А <br />Planning Commission. <br />Б <br />One item staff can clarify is the definition of principal use/structure (see definitions <br />В <br />below). Similar to the City Planner’s interpretation during the hearing, a lotorparcel <br />ЊЉ <br />can have more than one principal use or structure. Based off the definition, the <br />ЊЊ <br />Planning Division must apply the strictness of the Zoning Code requirements to the <br />ЊЋ <br />least impactful principal structure as was discussed on October 5. <br />ЊЌ <br />Principal: Designates the main use(s) or structure(s) to which the premises are <br />ЊЍ <br />devoted or the primary purpose(s) for which the premises exists <br />ЊЎ <br />Structure: A structure is anything constructed or erected, including paved <br />ЊЏ <br />surfaces, the use of which requires more or less permanent location on the ground, <br />ЊА <br />or attached to something having permanent location on the ground, and in the case <br />ЊБ <br />of floodplain areas, in the stream bed or lake bed. <br />ЊВ <br />The Planning Commission also sought an additional condition concerning the semi- <br />ЋЉ <br />trailers, which read: X % of semi-trailers shall be licensed and operational. <br />ЋЊ <br />Planning staff has given this proposed condition some thought and would suggest a <br />ЋЋ <br />starting point of 80%. We would also suggest that additional language be incorporated <br />ЋЌ <br />that requires any inoperable or unlicensed trailers to be stored at the rear of the site. <br />ЋЍ <br />We suggest the following: <br />ЋЎ <br />Outdoor storage of semi-trailers shall include a minimum of 80% of such trailers <br />ЋЏ <br />being licensed and operational. Those trailers that are not licensed and/or <br />ЋА <br />operational shall be stored at the rear of the premises. <br />ЋБ <br />Additionally, there were questions concerning trailers and what type of trailer the <br />ЋВ <br />proposal and/or Code was referring to. Staff has discussed this item and has modified <br />ЌЉ <br />the proposed text changes to clarify in the Industrial District and specifically associated <br />ЌЊ <br />with motor freight terminal use, semi-trailers are the type of trailers the Code should be <br />ЌЋ <br />enforcing. All other trailers should not be allowed to occupy the premises. <br />ЌЌ <br /> <br />
