Mr. Paschke advised that typically instructors for <br />508 <br />this use would come to teach their class(es) and not stay on site at all times. <br />509 <br />However, Mr. Paschke further clarified that city zoning code didn’t regulate how <br />510 <br />the business was run. <br />511 <br />Chair Boguszewski reiterated that staff’s rationale in the recommended conditions <br />512 <br />were related to class size and location of classes indoors specific to this proposal; <br />513 <br />and permanent employees and hours of operation were submitted by staff only to <br />514 <br />inform the Commission as to site specifics that could change based on the type of <br />515 <br />business in this multi-tenant building. Mr. Paschke confirmed that comment. <br />516 <br />th <br />Applicant Representative Dariash Moslemi, 702 N 4 Street, Stillwater, MN <br />517 <br />5002 (representing owner of the Yoga Studio) <br />518 <br />Mr. Moslemi stated their agreement with both of staff’s proposed conditions <br />519 <br />without problem. Given the street presence, Mr. Moslemi noted outdoor Yoga <br />520 <br />would not be acceptable for their students. Given their experience with other <br />521 <br />locations for their business, Mr. Moslemi advised that they added classes to <br />522 <br />control their size and as applicable to space available at a particular location and <br />523 <br />environment. Regarding employees, Mr. Moslemi clarified that their employees <br />524 <br />were typically outsourced instructors coming and going for their particular classes, <br />525 <br />and not on site all the time. Regarding the anticipated retail space, Mr. Moslemi <br />526 <br />advised that the space was not now open so no set business hours could be <br />527 <br />established. However, based on their operations in other communities, Mr. <br />528 <br />Moslemi opined parking would not be a problem with Yoga students coming and <br />529 <br />going during normal retail business hours. <br />530 <br />Chair Boguszewski clarified with the applicant that the proposed retail space <br />531 <br />would not be a destination spot drawing independent traffic. Chair Boguszewski <br />532 <br />also asked Mr. Moslemi to confirm that general parking concerns were not <br />533 <br />deemed problematic for their fitness studio use. <br />534 <br />Specific to the retail use, Mr. Moslemi agreed, advising it would be considered a <br />535 <br />side business for limited retail purposes. Regarding parking, Mr. Moslemi advised <br />536 <br />that this location had been chosen because it offered such a decent <br />537 <br />neighborhood, opining students could choose to walk versus drive to class. <br />538 <br />At the request of Member Murphy, Mr. Moslemi reviewed projected class sized <br />539 <br />and their experience over the course of five years with similar operations within <br />540 <br />their business model. Mr. Moslemi advised that their class sizes varied with time <br />541 <br />of day, typically below 18 students between 5:45 a.m. to 9:00 p.m.; with before <br />542 <br />and after work times the most popular, and mid-day classes usually providing for <br />543 <br />fewer students. With the existing office use in the multi-tenant building (Cygenics <br />544 <br />Lab) Mr. Moslemi noted their larger class sizes would typically be held before and <br />545 <br />after typical business hours. <br />546 <br />Public Comment <br />547 <br />Claudia Campbell, 1075 Harriet Lane <br />548 <br />Ms. Campbell noted her residence directly behind this building; and their concern <br />549 <br />with privacy with traffic coming and going with proposed hours of operation. <br />550 <br />Obviously from the comments made by Mr. Moslemi, Ms. Campbell referenced <br />551 <br />proposed business hours between 6:00 to 8:00 a.m. and 5:00 to 9:00 p.m. as well <br />552 <br />as Sundays until 8:30 p.m. Ms. Campbell noted the parking area was adjacent to <br />553 <br />their townhome building on the side and could be a big problem with headlights <br />554 <br />for vehicles coming accessing the site. Ms. Campbell asked if there was some <br />555 <br />way to address or avoid that situation. <br />556 <br />Member Cunningham asked if Ms. Campbell had experienced any issues with <br />557 <br />that when the former book store use was in this multi-tenant building.
