Attachment D <br />WHEREAS, City Code §1009.04 (Variances) establishes the purpose of a variance is "to <br />ЍЉ <br />permit adjustment to the zoning regulations where there are practical difficulties applying to a <br />ЍЊ <br />parcel of land or building that prevent the property from being used to the extent intended by <br />ЍЋ <br />the zoning;" and <br />ЍЌ <br />WHEREAS, the Variance Board has made the following findings: <br />ЍЍ <br />a.The proposal is consistent with the Comprehensive Plan. Although such <br />ЍЎ <br />improvements are not specifically identified in the 2030 Roseville Comprehensive <br />ЍЏ <br />Plan, Planning Division staff finds that the proposed site improvements <br />ЍА <br />(customer/employee parking and semi-trailer storage/parking) for which the variance <br />ЍБ <br />is necessary are generally consistent with the Comprehensive Plan (Employment Area <br />ЍВ <br />Goals and Policies). <br />ЎЉ <br />b.The proposal is in harmony with the purposes and intent of the zoning ordinances. <br />ЎЊ <br />The purpose of the Zoning Code is to set development standards that achieve the goals <br />ЎЋ <br />and policies of the Comprehensive Plan and that make good development sense. <br />ЎЌ <br />There are instances, like in the case of the subject property, where the design <br />ЎЍ <br />standards and existing improvements conflict with one another. Planning Division <br />ЎЎ <br />finds that the proposal to expand the northeast customer/employee parking lot area <br />ЎЏ <br />cannot be completed without a variance to §1006.05.E (Parking Placement). Similarly <br />ЎА <br />the proposed addition of a storage/parking area for 31 semi-trailers adjacent to the <br />ЎБ <br />existing dock facility also requires a variance. Both of these improvements will be <br />ЎВ <br />completed in the area between the building and the street, which is not permitted. A <br />ЏЉ <br />variance to each improvement grants allowance to make these improvements, which <br />ЏЊ <br />are consistent with the intent of the zoning ordinance. <br />ЏЋ <br />c.The proposal puts the subject property to use in a reasonable manner. Planning <br />ЏЌ <br />Division concludes that it is a reasonable to seek improvements to the pre-existing <br />ЏЍ <br />non-conforming parking lot and add additional improved semi-trailer <br />ЏЎ <br />storage/parking especially when site redevelopment (the only option to achieve <br />ЏЏ <br />compliance with all Zoning Code standards) is not being contemplated. <br />ЏА <br />d.There are unique circumstances to the property which were not created by the <br />ЏБ <br />landowner. It is safe to say that the need for variances to parking lot design and <br />ЏВ <br />placement are a direct result of the Zoning Code being amended in 2010. Such <br />АЉ <br />changes and subsequent non-conformity are not uncommon, however, there are <br />АЊ <br />instances, like in this case, where the improvements justify the approval of the <br />АЋ <br />requested variances. <br />АЌ <br />e.The variance, if granted, will not alter the essential character of the locality. <br />АЍ <br />Planning Division staff has determined that the requested variance for expanding a <br />АЎ <br />pre-existing non-conforming parking lot and the addition of a semi-trailer <br />АЏ <br />storage/parking area adjacent to the existing dock facility would not alter the essential <br />АА <br />character of the locality, as the area is generally developed with industrial uses that <br />АБ <br />date back to the 1970’s when the City Code included a much different set of use and <br />АВ <br />site development design standards. <br />БЉ <br />WHEREAS, §1009.04 (Variances) of the City Code also explains that the purpose of a <br />БЊ <br />variance is “to permit adjustment to the zoning regulations where there are practical difficulties <br />БЋ <br />applying to a parcel of land or building that prevent the property from being used to the extent <br />БЌ <br />intended by the zoning;” and <br />БЍ <br /> <br />
