CITY ORDINANCE 1103.07: PARK DEDICATION <br />Double Strikethrough: Language to be removed <br />Red Underlined: Language to be added <br />Purpose: Minnesota Statutes 462.358, subdivisions 2b and 2c regarding park dedication offers the <br />opportunity to improve and create connections to a system of open spaces, parks, and pathways as part <br />of the subdivision process. The City, at its discretion, will determine whether park dedication is required <br />in the form of land, cash contribution, or a combination of cash and land. This decision will be based on <br />existingand proposed development and on the goals, plans,and policies of the City including, but not <br />limited to, those embodied by the Parks and Recreation System Master Plan, Pathways Master Plan, and <br />Comprehensive Plan. <br />Condition to Approval: AsPark dedication will be required as a condition to the approval of any <br />subdivision of land in any zone, including the grantingresulting in a net increase of a variance pursuant <br />to Section 1104.04 of this Title, , by either platting or minor subdivision, and including redevelopment <br />and approval of planned unit developments, the subdivision shall be reviewed by the Park development <br />sites comprising more than one acre of land. The Parks and Recreation Commission. The commission <br />shall recommend, in accordance with Statute and after consulting the approved plans and policies noted <br />herein, either a portion of land to be dedicated to the public for use as a park as provided by Minnesota <br />Statutes 462.358, subdivision (2)(b),, or in lieu thereof, a cash deposit given to the City to be used for <br />park purposes;, or a combination of land and cash deposit,. If a tract of land to be divided encompasses <br />all as hereafter setforth <br />Amount to be Dedicated: The portion to beor part of a site designated as a planned park, recreational <br />facility, playground, trail, wetland, or open space dedicated in all residentially zoned areas shall be <br />10%for public use in the Comprehensive Plan, Pathways Master Plan, Parks and 5% in allRecreation <br />System Master Plan, or other areasrelevant City plan, the commission may recommend the applicant to <br />dedicate land in the locations and dimensions indicated on said plan or map to fulfil all or part of the <br />park dedication requirement. <br />Park Dedication Fees: Park dedication fees shall be reviewed and determined annually by City Council <br />resolution and established in the fee schedule in Chapter 314 of this Code. <br />Utility Dedications Not Qualified: Land dedicated for required street right -of -way or utilities, including <br />drainage, does not qualify as park dedication. <br />Payment in lieu of dedication in: In all zones in the city where park dedication of land is deemed <br />inappropriate by the City, the owner and the City shall agree to have the owner deposit a sum of money <br />in lieu of a dedication. The sum shall be reviewed and determined annually by the City Council by <br />resolution. <br /> <br />
