Attachment A <br />1028 <br /> 2. CHARGES; LIENS. Borrower shall pay all taxes, assessments, charges, fines, <br />1029 <br />and impositions attributable to the Property which may attain priority over this Mortgage, and <br />1030 <br />leasehold payments or ground rents, if any. Borrower shall pay these obligations on time <br />1031 <br />directly to the person owed payment. <br />1032 <br />1033 <br />Borrower shall promptly discharge any lien which has priority over this Mortgage and is <br />1034 <br />not listed in paragraph 17, unless Borrower: (a) agrees in writing to the payment of the <br />1035 <br />obligation secured by the lien in a manner reasonably acceptable to the Authority; (b) contests in <br />1036 <br />good faith the lien by, or defends against enforcement of the lien in, legal proceedings which in <br />1037 <br />the Authority’s opinion operate to prevent the enforcement of the lien; or (c) secures from the <br />1038 <br />holder of the lien an agreement satisfactory to the Authority subordinating the lien to this <br />1039 <br />Mortgage. If the Authority determines that any part of the Property is subject to a lien which <br />1040 <br />may attain priority over this Mortgage, the Authority may give Borrower a notice identifying the <br />1041 <br />lien. Borrower shall satisfy the lien or take one or more of the actions set forth above within <br />1042 <br />thirty (30) days of the giving of notice. <br />1043 <br />1044 <br />3. HAZARD OR PROPERTY INSURANCE. Borrower shall keep the <br />1045 <br />improvements now existing or hereafter erected on the Property insured against loss by fire and <br />1046 <br />any other hazards for which the Authority requires insurance. This insurance shall be <br />1047 <br />maintained in the amounts and for the periods that the Authority reasonably requires. The <br />1048 <br />insurance carrier providing the insurance shall be chosen by Borrower subject to the Authority’s <br />1049 <br />approval, which shall not be unreasonably withheld or delayed. If Borrower fails to maintain <br />1050 <br />coverage described above, the Authority may, at the Authority’s option, obtain coverage to <br />1051 <br />protect the Authority’s rights in the Property in accordance with paragraph 5. <br />1052 <br />1053 <br />All insurance policies and renewals shall be reasonably acceptable to the Authority and <br />1054 <br />shall include a standard mortgage clause. If the Authority requires, Borrower shall promptly <br />1055 <br />give to the Authority all receipts of paid premiums and renewal notices. In the event of loss, <br />1056 <br />Borrower shall give prompt notice to the insurance carrier and the Authority. The Authority may <br />1057 <br />make proof of loss if not made promptly by Borrower. <br />1058 <br />1059 <br /> If under paragraph 15 the Property is acquired by the Authority, Borrower’s right to any <br />1060 <br />insurance policies and proceeds resulting from damage to the Property prior to the acquisition <br />1061 <br />shall pass to the Authority to the extent of the sums secured by this Mortgage immediately prior <br />1062 <br />to the acquisition. <br />1063 <br />1064 <br /> 4. PROTECTION OF THE PROPERTY. Borrower shall not destroy or damage the <br />1065 <br />Property or commit waste on the Property. Borrower shall be in default if any forfeiture action <br />1066 <br />or proceeding, whether civil or criminal, is begun that in the Authority’s good faith judgment <br />1067 <br />could result in forfeiture of the Property or otherwise materially impair the lien created by this <br />1068 <br />Mortgage or the Authority’s security interest. Borrower may cure such a default and reinstate, as <br />1069 <br />provided in paragraph 13, by causing the action or proceeding to be dismissed with a ruling that, <br />1070 <br />in the Authority’s good faith determination, precludes forfeiture of Borrower’s interest in the <br />1071 <br />Property or other material impairment of the lien created by this Mortgage or the Authority’s <br />1072 <br />security interest.
