they've been inquiring about other funds that might have some discretionary uses including the Police Forfeiture Funds.
The underlying premise in play is that any funds that might reliably come from Police Forfeiture, might then not have to come from property taxes; thereby freeing up those property taxes to meet other capital needs.
The Commission is aware of your general comments regarding the use of those funds; but they're seeking some additional legal guidance. Would you be able to draft a brief memo outlining some specific uses that goes
beyond the language offered in State Statute?
Thanks.
Chris Miller Finance Director
From: pz@petezeller.com [mailto:pz@petezeller.com]
Sent: Thursday, October 22, 2015 7:55 AM
To: Chris Miller <Chris.Miller@cityofroseville.corrp
Cc: Justin Rohloff <justinrohloffc@hotmail.com>
Subject: Questions regarding Police fofeiture fund
Good Morning Chris,
Justin and I drafted the following for the City Attorney. Thank you for offering to forward this to him.
Regards, Pete
To: Roseville City Attorney,
Materials prepared by Roseville City Staff for the October 13th Finance Commission meeting included
backgrotmd information related to the Roseville Law Enforcement fund. Money in this fund represents the balance of property and cash forfeitures by the Roseville Police Department. The agenda
infonnation included excerpts of MN Statute 609.531 which outlines circwnstances which can lead to
property being confiscated and sold by the City. As of December 31, 2014, there was $479,360 in this Law Enforcement fund which was categorized as "restricted 11 in the Roseville Comprehensive Annual Financial Report.
While the Finance Conimission learned quite a bit regarding how property can be seized and
distributed, questions remain regarding spending these proceeds. Specifically, the Finance Commission would like to know:
1)What guidance state law provides related to the use of this money, and
2)What legal restrictions, if any, are on the funds placed in this account.
Any statutory reference you can provide in this regard would be most appreciated.
Thank you,
Pete Zeller Justin Rohloff Roseville Finance Commission
2
Item 8: Attachment C
