Roll Call <br /> Mayor Roe called the meeting to order at approximately 6:00 p.m. Voting and Seating <br /> Order: McGehee, Willmus, Laliberte, Etten and Roe. City Manager Trudgeon and City <br /> Attorney Mark Gaughan were also present. <br /> 2. Pledge of Allegiance <br /> 3. Approve Agenda <br /> Councilmember Laliberte requested removal of Item 9.n from the Consent Agenda for <br /> separate consideration. <br /> Willmus moved, McGehee seconded, approval of the agenda as amended <br /> Roll Call <br /> Ayes: McGehee, Willmus, Laliberte, Etten and Roe. <br /> Nays: None. <br /> 4. Public Comment <br /> 5. Recognitions,Donations and Communications <br /> 6. Items Removed from Consent Agenda <br /> n. Execute a Settlement Agreement with Dorso Building Company, LLP and <br /> Interveners for a Period of Five Years <br /> At the request of Mayor Roe, City Manager Trudgeon briefly highlighted this <br /> item as detailed in the Request for Council Action (RCA) and related attachments <br /> dated November 6, 2017. <br /> At the request of Mayor Roe, City Manager Trudgeon provided a background on <br /> how this property had reached this point for several decades in attempting resolu- <br /> tion by both parties on code enforcement and land use and outdoor storage city <br /> code violations, assertion of ongoing permitted legal, non-conforming use de- <br /> scribed by the property owner, and other site issues. Mr. Trudgeon confirmed that <br /> the city was concerned with life safety issues on the site, in addition to improper <br /> storage and land use issues resulting in continued disagreement between the city <br /> and Mr. Dorso. Mr. Trudgeon noted that the other alternative to this draft agree- <br /> ment (Attachment A) negotiated by City Attorney Gaughan and Dorso's Attorney <br /> John Martin would be for more extensive and costly litigation with an unknown <br /> determination by the court as to its resolution. While not perfect, Mr. Trudgeon <br /> noted that it would provide resolution for both parties to move forward. <br />
