� <br />SHOREVIEW CITY COUNCIL - SEPTEMBER 2, 1997 <br />13 <br />Joint Powers Agreement on May 19, 1997, subject to an amendment to prohibit motorized <br />watercraft from passing between a raft and a shoreliune. Meetings between representatives of <br />both cides have resulted in the proposed revisions for a new Joint Powers Agreement that is <br />accepted by the Lake Regulations Committee, the Roseville Lakes Association. These <br />revisions have been submitted to the DNR. <br />Councilmember Landwehr stated that the issue discussed previously concerned swimmers and <br />the presence of boats between rafts and the shoreline. The language now states, "When a <br />sWimmer is present...". Mr. Ebeling explained that City representatives came to the <br />conclusion that enforcement agencies would rely op, the sentence immediately preceding: ' <br />"Persons operating a motorboat, being towed on waterskis or a similar device shall, at all . <br />times, maintain an adequate distance (considering speed and condidons) from other <br />watercraft, swim rafts, and docks, as to avoid an accident. " It will be difficult for water <br />patrol safety o�cers to determine whether there is a swimmer above water or underwater. If <br />the situation is unsafe, a citation can be issued on the basis of the above provision. <br />Councilmember Landwehr expressed concem about a situadon that might be prosecuted on <br />the basis of "ad'equate distance and speed. " This language is too broad to give enough <br />guidance and he would prefer to see a specific prohibition. <br />Councilmember Wickstrom stated that she has the same concem and suggested striking the <br />part of the sentence that states, "when a swimmer is present. " Mr. Ebeling stated that the <br />reason for the new language is to allow fishermen to troll between rafts and the shore. If that <br />pbrase is stricken, fishermen would not be able to troll. <br />Mr. Nito Quitevis, Chair, Lake Regulations Committee, stated that the Committee agrees <br />with the proposed language. If the language were to be changed as suggested by <br />Councilmember Wickstrom, lake use by fishermen would be limited. The Committee sees no <br />reason to make that limitadon, and the proposed language is word.ing that has been used by <br />the DNR successfiilly over time. He believes the language is the best it can be to be <br />workable on lakes, and the Committee is very comfortable with it. <br />Councilmember Wickstrom asked if speed limits between rafts and the shoreline can be <br />limited. Mr. Schwerm stated that 150 feet from the shoreline is already a slow/no wake <br />zone. The majority of rafts are within 150 feet. Any boats within this area would have to <br />travel at a slow/no wake speed. <br />Mayor Martin stated that she is comfortable accepting the recommencfadons of. the <br />Committee. <br />MOTION: by Councilmember Huffman, seconded by Councilmember Reiter to rescind <br />the Joint Powers Agreement between the City of Shoreview and the City of <br />Roseville for Lake Owasso water surface reguladons approved on May 19, <br />1997. <br />
