� <br />� ! JOINT POWERS AGREENIENT <br />LAKE OWASSO <br />WATER 5URFACE USE <br />I. PARTIES. This Agreement is made and entered into by and between the CITY OF <br />SHOREVIEW, a municipal corporation and political subdivision of the State of Minnesota, <br />(herein "Shoreview"), and the CITY OF ROSEVILLE, a municipal corporation and political <br />subdivision of the State of Minnesota ("herein "Roseville"). <br />II. RECITALS. Lake Owasso is located within the corporation boundaries of Shoreview <br />and Roseville and has a large public access for boats. The waters of Lake Owasso are used <br />extensively by the public for boating, fishing and other recreational purposes, <br />Regulation of boating traffic on Lake Owasso is necessary in order to protect the health, safety <br />and welfare of the residents of Shoreview and Roseville who reside on properties surrounding <br />Lake Owasso and of those people who use Lake Owasso for recreational purposes. By means <br />of this Joint Powers Agreement adopted pursuant to Minn. Stat. §§ 459.20 and 471.59. <br />Shoreview and Roseville will establish guidelines applicable to the adoption of ordinances by <br />each City restricting the speed and use of motorboats on Lake Owasso. <br />III. TERMS AND CONDITION5. In consideration of the mutual undertakings herein <br />1 expressed, 5horeview and Roseville agree as follows: <br />A. Each City shall adopt an ordinance which incorporates the following guidelines: <br />1, Adopts the deiinitions of Minn. Stat. §86B.005. <br />2. Motorboat speed on Lake Owasso shall not exceed forty miles per hour (40 mph) <br />which speed limit shall be in effect 24 hours per day. <br />3. No person shall operate a motorboat or be towed on water skis or a similar device <br />at greater than a slow-no wake speed within 150 feet of shore. Launching or <br />landing a skier by the most direct route to open water shall be exempt from this <br />provision. <br />4, Persons operating a motorboat, and those being towed on water skis or a similar <br />device shall, at all times, maintain an adequate distance (considering speed and <br />conditions) from other watercraft, swimmers, swim rafts and docks, so as to <br />avoid an accident. When a swimmer is present, motorboats or persons being <br />towed on water skis or a similar device, shall not pass between a swim raft and <br />the nearest shore. <br />Exemptions: <br />i.
