EXTRACT OF MINUTES OF MEETING OF THE
CITY COUNCIL OF THE CITY OF ROSEVILLE
Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville,
County of Ramsey, Minnesota, was held on the 29`"day of January, 2018 at 6:00 p.m.
The following Council Members were present: Laliberte, McGehee, Willmus, Etten and Roe;
and none were absent.
Council Member Willmus introduced the following resolution and moved its adoption:
RESOLUTION NO. 11484
A RESOLUTION APPROVING A CONDITIONAL USE PURSUANT TO 1009.02.0 AND
1009.02.D.12 OF THE CITY CODE FOR PORTILLO'S RESTAURANT,
1800 COUNTY ROAD B2 (PF17-020)
WHEREAS, City Code §1009.02.0 establishes general Conditional Use (CU) criteria that is
required to be met by a CU proposal; and
WHEREAS, §1009.02.D. 12 establishes specific CU criteria for a drive-through that is also
required to be met; and
WHEREAS, the Roseville Planning Commission held the public hearing regarding the proposed
CU on January 3, 2018, voting 7-0 to recommend approval of the use based on public testimony and the
comments and findings of the staff report prepared for said public hearing; and
WHEREAS, the property at 1800 County Road B2 is legally described as:
Lot 2, block 1, Rosedale Center Sixth Addition
WHEREAS, the City Council has determined that approval of the proposed CU to permit the
installation of a drive-through at 1800 County Road B2 pursuant to §1009.02.0 and §1009.02.D.12 of
the City Code will not result in adverse impacts to the surrounding properties based on the following
findings:
GENERAL CONDITIONAL USE CRITERIA: §1009.02.0:
a. The proposed use is not in conflict with the Comprehensive Plan. While a drive-through facility
doesn't appreciably advance the goals of the Comprehensive Plan aside from facilitating continued
investment in a property, Planning Division believes that it does not conflict with the
Comprehensive Plan.
b. The proposed use is not in conflict with a Regulating Map or other adopted plan. The proposed use
is not in conflict with such plans because none apply to the property.
c. The proposed use is not in conflict with any City Code requirements. Planning Division staff
believes that the proposed drive-through facility can and will meet all applicable City Code
requirements; moreover, a CONDiTiONAL USE approval can be rescinded if the approved use fails to
comply with all applicable Code requirements or any conditions of the approval.
d. The proposed use will not create an excessive burden on parks, streets, and other public facilities.
The Planning Division staff does not expect the proposal to intensify any practical impacts on parks,
streets, or public infrastructure. There will be an increase in traffic, however, this traffic is
anticipated to be primarily interior and not significant, nor impactful to the adjacent public roadway
system.
Page i of 4
