The proposed use will not be injurious to the surrounding neighborhood, will not negatively impact <br /> traffic or property values, and will not otherwise harm the public health, safety, and general welfare. <br /> City staff anticipates that if the drive-through facility is approved, increased vehicle trips on the <br /> adjacent roadways will increase slightly, but will be manageable under current design. This area is <br /> predominately retail and the proposed drive-through should not impact surrounding properties, <br /> especially given additional Zoning Code requirements for the site. <br /> SPECIFIC CONDITIONAL USE CRITERIA- §1009.02.D.12 <br /> a. Drive-through lanes and service windows shall be located to the side or rear of buildings and shall <br /> not be located between the principal structure and a public street except when the parcel and/or <br /> structure lies adjacent to more than one public street and the placement is approved by the <br /> Community Development Department(Ord. 1443, 6-17-2013). The proposed drive-through has <br /> been oriented toward County Road B, which is an acceptable design. <br /> b. Points of vehicular ingress and egress shall be located at least 60 feet from the street right-of-way <br /> lines of the nearest intersection. Vehicular ingress/egress related to the proposed drive-through <br /> facility lies along the internal ring-road for Rosedale and not directly adjacent a public street <br /> intersection. The location of the ingress/egress points has been reviewed and approved by the City <br /> Engineer. <br /> c. The applicant shall submit a circulation plan that demonstrates that the use will not interfere with or <br /> reduce the safety of pedestrian and bicyclist movements. Site design shall accommodate a logical <br /> and safe vehicle and pedestrian circulation pattern. Adequate queuing lane space shall be provided <br /> without interfering with on-site parking/circulation. The proposed site plan indicates a <br /> pedestrian/bike connection from County Road B2 adjacent to the Rosedale ingress, which crosses <br /> through the parking lot via designated sidewalk and/or highlighted crosswalks. There is also a <br /> pedestrian connection from the Penney's lot across the ring-road via a striped crosswalk. The <br /> Planning and Engineering staff worked with the applicant on an acceptable-pedestrian route/location. <br /> d. Speaker box sounds from the drive-through lane shall not be loud enough to constitute a nuisance on <br /> an abutting residentially zoned property or property in residential use. This requirement does not <br /> apply because the drive-through lane is not adjacent to a residential property, <br /> e. Drive-through canopies and other structures, where present, shall be constructed from the same <br /> materials as the primary building and with a similar level of architectural quality and detailing. <br /> The proposed plans do not indicate and canopy or structure requiring this design requirement. <br /> L A 10 foot buffer area with screen planting and/or an opaque wall or fence between 6 and 8 feet in <br /> height shall be required between the drive-through lane and any property line adjoining a public <br /> street or residentially zoned property or property in residential use and approved by the Community <br /> Development Department(Ord. 1443, 6-17-2013). Because the drive-through lane lies directly <br /> adjacent to County Road B2 and Fairview screening is required. The current proposal calls for a <br /> fence of six feet to be installed adjacent to the drive-through lane along County Road B2 and a <br /> portion of Fairview Avenue, which will be augmented with trees and shrubbery on either side of <br /> fence. The Planning Division requests that it continue working with the applicant on a final design <br /> for both type/style of fence, overall fence location, and landscaping. <br /> WHEREAS, the Roseville Planning Commission voted 7-0 to recommended to the City Council <br /> approval of the CU for a drive-through, subject to the following condition: <br /> 1.
