Attachment G <br />1017.24: PLANNED UNIT DEVELOPMENT REQUIREMENTS - <br />REPEALED (Ord. 1405, 2-28-2011) <br />1017.25: GRADING, FILLING AND LAND ALTERATION: <br />A. Permit Required: No person, firm or corporation may engage in any excavation, <br />grading, surfacing or filling of land in the City without first securing a permit as set <br />forth in this Section. <br />1. Permit from City Engineer/Public Works Director: A permit is required from the City <br />Engineer/Public Works Director or designee, for any of the following activities: <br />a. Placement of or grading of more than ten cubic yards of material on steep slopes <br />adjacent to lakes and wetlands or within the shore or bluff impact zones. <br />b. Placement of or grading of more than 50 cubic yards of earthen material anywhere <br />in the City. <br />c. Where filling or grading occurs within ten feet of a property line or when such <br />activity alters the drainage patterns of adjacent properties. <br />2. Permit from City Council: A permit from the City Council is required for any <br />projects meeting the following criteria: <br />a. Any fill, grading, or drainage of a public water or a wetland, provided the City <br />Council first determines that the project is either exempt from the 1991 Wetlands <br />Conservation Act or certifies the replacement of any loss of wetland area, values and <br />functions in accordance with Minnesota Rules, Chapter 8420 as amended. Questions <br />relating to wetland type, location, area, functions and values must be referred to the <br />technical advisory panel established by Minnesota Statutes section 103G.2242 as <br />amended. <br />b. For any filling or excavating on developed land zoned LDR-1 or LDR-2 where the <br />site is less than one acre and the fill or excavation exceeds 500 cubic yards. For any filling or excavating on developed land zoned LDR-1 or LDR-2 where the <br />site is one acre or greater and the proposed fill/excavation exceeds 1,000 cubic yards. <br />(Ord. 1405, 2-28-2011) <br />d. For any filling or excavating on undeveloped land zoned LDR-1 or LDR-2 where <br />the site is less than one acre and the proposed fill/excavation exceeds 2,000 cubic <br />yards. For any filling or excavating on undeveloped land zoned LDR-1 or LDR-2 where <br />the site is greater than one acre and the proposed fill/excavation exceeds 4,000 cubic <br />yards. (Ord. 1405, 2-28-2011) <br />f For any filling or excavating on developed commercial/industrial property where <br />the site is less than two and one-half acres and the proposed fill/excavation exceeds <br />2,500 cubic yards. <br />g. For any filling or excavating on developed commercial/industrial property where <br />the site is greater than two and one-half acres and the proposed fill/excavation <br />exceeds 5,000 cubic yards. <br />h. For any filling or excavating on undeveloped commercial/industrial property <br />where the site is less than two and one-half acres and the proposed fill/excavation <br />exceeds 5,000 cubic yards. <br />i. For any filling or excavating on undeveloped commercial/industrial property where <br />the site is greater than two and one-half acres and the proposed fill/excavation <br />exceeds 10,000 cubic yards. <br />B. Applications For Permits, Additional Information: All applications for permits for <br />grading and filling activities or land disturbances within the overlay district shall be <br />accompanied by plans, specifications, and completion schedules in conformance with <br />
