<br />C. Building Permits, Special Provisions: All building permits involving any excavation, fill
<br />or grading shall contain special provisions that specify:
<br />1. That the permittee is responsible for the cleanup and any damages resulting from soil
<br />eroded from the building site onto public streets, into the storm sewer system and onto
<br />any adjoining private property as required in Section 803.04: Erosion and
<br />Sedimentation Control; and(Ord. 1342, 11-13-2006)
<br />2. That the permittee shall install and maintain erosion control as required in Section
<br />803.04: Erosion and Sedimentation Control. (Ord. 1342, 11-13-2006) (Ord. 1416, 9-26-

<br />D. Shoreland Alterations: Alterations of vegetation and topography shall be regulated to
<br />prevent erosion into public waters, fix nutrients, preserve shoreland aesthetics, preserve
<br />historic values, prevent bank slumping, and protect fish and wildlife habitat. Fill and
<br />grading activities within shoreland shall comply with subsections 1017.24A2a through
<br />A2i and 1017.24B. Erosion control measures shall comply with Section 803.04: Erosion

<br />E. Vegetation Alterations in Shoreland Areas:
<br />1. Exemption: Vegetation alteration necessary for the construction of structures and
<br />roads and parking areas regulated by Sections 1017.14 through 1017.16 of this Chapter
<br />are exempt from the vegetation alteration standards that follow.
<br />2. Vegetation Alteration Standards: Removal or alteration of vegetation is allowed
<br />subject to the following standards:
<br />a. Intensive vegetation clearing within the shore and bluff impact zones and on steep
<br />slopes is not allowed. Intensive vegetation clearing outside of the impact zones is
<br />allowable as a conditional use if an erosion control and sedimentation plan is
<br />developed per the requirements of Section803.04: Erosion and Sedimentation

<br />b. In shore and bluff impact zones and on steep slopes, limited clearing of trees and
<br />shrubs and cutting, pruning, and trimming of trees may be allowed to provide a view
<br />to the water from the principal dwelling site and to accommodate the placement of
<br />lawns and new vegetation, stairways and landings, picnic areas, access paths, beach
<br />and watercraft access areas, and permitted water -oriented accessory structures or
<br />facilities, provided that the screening of structures, vehicles, or other facilities as
<br />viewed from the water, assuming summer, leaf -on conditions, is not substantially
<br />reduced; and
<br />c. The above provisions are not applicable to the removal of trees, limbs, or branches
<br />that are dead, diseased, or pose safety hazards.
<br />3. Connections to Public Waters: Excavations where the intended purpose is connection
<br />to a public water, such as boat slips, canals, lagoons, and harbors, shall be controlled by
<br />subsections A through D of this section. Permission for excavations may be given only
<br />after the commissioner has approved the proposed connection to public waters and other
<br />needed approvals have been obtained. (Ord. 1156, 12-12-1994)

<br />1017.26: STORM WATER MANAGEMENT:
<br />The following general and specific standards shall apply to all developments within the city:
<br />A. General Standards:
<br />1. Existing Natural Drainageways: When possible, existing natural drainageways, and
<br />vegetated soil surfaces shall be used to convey, store, filter, and retain storm water
