The City needs to be as specific as possible in the ordinance, but it is in <br /> reality only slightly easier to change a policy than an ordinance, since both require <br /> a simple council majority vote. <br /> Public Works Director Culver noted he would like to have some discussion on the <br /> proposed language surrounding sewer and water. <br /> Councilmember Etten noted the recent Met Council project is a months-long pro- <br /> ject which will have a very different impact on the areas. Something like that <br /> should go through a more robust process. Perhaps something with a time bounda- <br /> ry of two nights or fewer is an option. If the Council is approving the policy, then <br /> perhaps it should just be put in the ordinance. He would like to hear feedback <br /> from the staff as well. <br /> Mayor Roe noted there are policies that Council does not approve, and this lan- <br /> guage specifically refers to Council approval. <br /> Councilmember McGehee stated she does not care if it is included in the ordi- <br /> nance or in the policy. She does, however, have an issue with cart-blanche per- <br /> mission for entities other than the City. She has confidence in the City staff and <br /> the amount of control the Council has. She is concerned if the Met Council may <br /> have different standards. <br /> Mayor Roe noted that Met Council theoretically would still have to have staff <br /> approval if they were included with the city in the exceptions. <br /> Councilmember McGehee stated she is fine with one night or two nights. <br /> Councilmember Willmus indicated he likes this in the ordinance. A change of <br /> policy can be done easily and quickly by a Council. For example, if a future <br /> Council wants to include asphalt reclamation or concrete crushing, that is a differ- <br /> ent animal but would be easy to do with very little public input. If the Council <br /> decides to change the ordinance, it is best to be as specific as possible. Within the <br /> ordinance, referring to sanitary sewer line or water main valve replacement, it <br /> should be included. <br /> Councilmember Laliberte suggested the ordinance language should be much more <br /> specific. She agreed there should be specific language as to what is being sug- <br /> gested, so perhaps this should come back before the Council. <br /> After extensive discussion, the Council concluded this item needs to come back <br /> for further consideration. More specificity in the code is preferred, rather than a <br /> separate policy, perhaps including the three items in the policy in abbreviated <br /> form,perhaps with a timeframe. <br />
