Regular City Council Meeting <br /> Monday,March 12,2018 <br /> Page 17 <br /> Councilmember McGehee disagreed with Councilmember Willmus' comments. <br /> People who have a problem with the City's Public Works plans have shown up <br /> early and during the process and the City Council has every opportunity to work <br /> with them. The staff has shown longstanding and consistent desire to have a good <br /> working relationship with the community. She understands the concern about <br /> roofs at midnight,but the City government is serving the residents, notifying them <br /> of the work that has to be done. This will be done at least a week in advance, so <br /> there is time to notify the Council. This is one area where the Council spends <br /> more time than is necessary on holding these hearings, and the current ordinance <br /> also makes more paperwork for staff and the Council. <br /> Councilmember Willmus responded that repair of sewer and water line is one is- <br /> sue. A different issue would be if the City needs to replace a street. <br /> Councilmember Laliberte stated she errs on the side that the Council needs to en- <br /> sure the community knows what is happening. She believes that is a service that <br /> is owed to the community. Neither version is specific enough, in her view. She <br /> does not have a problem with the current process. <br /> Councilmember Etten agreed it is easy to change policy. He originally did not <br /> notice Attachment E, which includes the night-related work policy and specifies <br /> the reasons for the work and how people are noticed. Attachment E also gives <br /> specific circumstances for the most likely types of work. Staffs point is that they <br /> can get the projects done a lot easier and improve the public benefit more quickly. <br /> Staff is not going to not do it, so the question is whether it can be expedited. If <br /> specifics should be baked into the ordinance,that is a discussion he is willing to <br /> have. <br /> Mayor Roe asked whether the noise impact will be over an extended period of <br /> time, or just during one night. <br /> Mr. Freihammer noted that it is usually one night, possibly two nights. He cannot <br /> think of any type of project that would occur an extended period of time at night. <br /> Mayor Roe noted that might be something to put into the language or the policy. <br /> Councilmember Willmus suggested that instead of saying "any" construction or <br /> maintenance activity, perhaps it can instead say "construction or maintenance ac- <br /> tivity directly related to or referencing sanitary sewer or water main line. " <br /> Mayor Roe noted the proposed staff change says the City Council must adopt the <br /> policy as well. He has some difficulty giving the City a different path than any- <br /> one else may be able to have. Perhaps exemptions can include entities other than <br /> the City if the same conditions apply, if they are doing something in the public <br /> right-of-way, related to the water and sewer.
