Regular City Council Meeting <br /> Monday,June 4, 2018 <br /> Page 11 <br /> Mayor Roe suggested staff bring back updated language for definitions as well as <br /> any changes the Council may decide upon. <br /> Councilmember Etten commented on Mayor Roe's revised language on item B on <br /> Attachment B, "of the public view" should actually read"out of the public view." <br /> Building Official Englund noted that definitions of multiple residential dwellings <br /> should be placed into 403. <br /> Mayor Roe suggested staff just make a reference to 402, and then refer to that in <br /> 403. That would simplify a lot of the language. <br /> Discuss Possible Allowance of Items Placed for Sale by Residents in Right of <br /> Way <br /> Building Official Englund briefly reviewed this request, recommending approval <br /> as detailed in the RCA dated June 4, 2018. <br /> Councilmember McGehee stated the system that was in place was working very <br /> well. Issues were handled on a complaint basis. The problem was created by the <br /> newsletter article which made it clear that it was against City code. There are a <br /> number of people in the community who put things they no longer need out for <br /> others and and now there is no sanctioned option to do so. It is a nice opportuni- <br /> ty for people to pick up a baby stroller or a garden hose, and these things tend to <br /> disappear very quickly. A couch that has been out in the rainstorms should have a <br /> visit from Mr. Englund, but that is an unusual occurrence. <br /> Councilmember Willmus suggested looking at the ordinance and allowing people <br /> to put things on the curb. <br /> Councilmember Etten concurred the system was working just fine. There are <br /> some cases on County Road B where people put cars in the front yard or couches <br /> there for a long time. By the time a complaint is issued, the items are usually <br /> gone. The system worked just fine. <br /> Councilmember Laliberte concurred the system was working fine. However, she <br /> has seen more situations where a bookshelf has sat out for two or three weeks. <br /> She would like to stay with the current situation. <br /> Mayor Roe commented he does not believe there should be language in the nui- <br /> sance code exempting this activity, because the current language provides for en- <br /> forcement when it is needed. He noted there is a restriction requiring automobiles <br /> be placed on an improved surface whether they are for sale or not. He wants to <br /> ensure the City is not sending messages to not obey the law, but there are limited <br /> resources to enforce it as rigorously as some people would want. <br />
