Consider an Amendment to Chapter 306, Cigarette and Tobacco Products, Raising the Minimum Age to Purchase Tobacco Products Assistant City Manager Olson briefly highlighted this item as detailed in the RCA and related attachments dated June 18, 2018. She noted the recent Minnesota De- partment of Health study which found an increase in tobacco use among middle and high schoolers. This is the first time in 17 years there has been a documented increase in tobacco use. This is partially attributed to the popularity of e-vaping, which also can be used to vape marijuana. Several surrounding communities have raised the tobacco age to 21, including Edina, St. Louis Park, Bloomington, and Plymouth. Additionally, five states have raised the age to 21, including Ha- waii, California, Maine, New Jersey, and Oregon. Assistant City Manager Olson continued that the City of Roseville has contacted all 28 tobacco license holders, all of whom were sent a notification of this upcom- ing Council discussion. A meeting was held May 24th, and only one retailer at- tended. Staff did hear some feedback, and it was taken into account. The draft before the Council includes a provision that will exempt tobacco shops from some of the self-service prohibitions if they meet the requirements. That was modeled after a provision in Edina's ordinance. E-cigarettes are included in this proposal. Assistant City Manager Olson walked through the changes in the ordinance. The first section covers the findings of fact and purpose as well as several definitions. The "harm reduction" language was also removed because the FDA does not use that language for these products. She pointed out the 1St, 2nd ,3rd, and 4th violation penalties. There are also violations for selling tobacco underage. Councilmember Laliberte asked about the violations on the fee schedule and the 24-month period. Assistant City Manager Olson explained it is a rolling 24-month period, based upon the compliance checks. Councilmember Laliberte noted the data in the staff report from Needham, Mas- sachusetts. She asked if the two Roseville school districts have been contacted to get current data. Assistant City Manager Olson responded staff only has the data from the annual tobacco study that was conducted in Minnesota.
