constitute a danger of significant harm to persons, or to domestic animals,or <br /> to wild or feral animals that are not nuisance animals. <br /> (b) Trapping by a person using a cage trap for the purpose of releasing an <br /> animal without significant harm. Cage traps must be tended to at leastonce <br /> every twenty-four (24)hours <br /> (c) Trapping done by the City or on its behalf and employees and or agents <br /> of a governmental unit utilizing a cage trap for humane and other purposes. <br /> (d) Trapping by any necessary means or methods with written permission <br /> and instructions from the City Manager by: <br /> 1. Scientists in order to identify or study animals, so long as animals <br /> are returned to their natural environment without significant <br /> harm. <br /> 2. Persons with a valid trapping license issued by the state <br /> When other effective and practical means or trapping methods are available, <br /> necessary means or methods shall not include those that result in injury or <br /> death to target animals, nor those that endanger persons or non-target animals. <br /> 512.05 COMPLIANCE WITH LAW <br /> Any trapping allowed under this Chapter shall be done in accordance with all applicable <br /> state and federal laws. <br /> 512.06 PENALTY <br /> Any person who violates any provision of this Chapter shall be subject to criminal and/or <br /> administrative penalties as forth below. <br /> (a) Criminal Penalty. A violation of any provision of this Chapter shall constitute a <br /> misdemeanor. <br /> (b) Administrative Penalty. A violation of any provision of this Chapter shall <br /> constitute an administrative offense under section 101.02.C. of City Code and <br /> subject to the applicable fees set forth in Chapter 314 of City Code. <br /> SECTION 2: Effective date. This ordinance shall take effect upon its passage and <br /> publication. <br /> Passed by the City Council of the City of Roseville this 9th day of July 2018. <br />
