EXTRACT OF MINUTES OF MEETING OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, <br /> County of Ramsey, Minnesota, was held on the 13th day of August, 2018 at 6:00 p.m. <br /> The following Council Members were present: Willmus, Laliberte, Etten, McGehee and Roe; <br /> and none were absent. <br /> Council Member McGehee_introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 11525 <br /> A RESOLUTION APPROVING A CONDITIONAL USE PURSUANT TO 1009.02.0 OF THE <br /> CITY CODE FOR, 2630, 2644, 2654, 2656, AND 2666 LEXINGTON AVENUE (PF18-012) <br /> WHEREAS, City Code §1009.02.0 establishes general Conditional Use (CU) criteria that is <br /> required to be met by a CU proposal; and <br /> WHEREAS, the Roseville Planning Commission held the public hearing regarding the proposed <br /> CU on July 11, and August 1, 2018, voting 7-0 to recommend approval of the building (roof)height <br /> increase from 45 feet to 55-1/2 feet based on public testimony and the comments and findings of the <br /> staff report prepared for said public hearing; and <br /> WHEREAS, the property at 2630, 2644, 2654, 2656, and 2666 Lexington Avenue is legally <br /> described as: <br /> REQUIRES LEGAL DESCRIPTION <br /> WHEREAS, the City Council has determined that approval of the proposed CU to permit an <br /> increase in building height from 45 feet to 55-1/2 feet pursuant to §1009.02.0 of the City Code will not <br /> result in adverse impacts to the surrounding properties based on the following findings: <br /> GENERAL CONDITIONAL USE CRITERIA: §1009.02.C: <br /> 1. The proposed use is not in conflict with the Comprehensive Plan: The use of the property for the <br /> development of an apartment complex is a permitted use, while increased density and/or building <br /> height requires a Conditional Use. The proposal to have 96 units satisfies the density limitation, <br /> however the increase in height from 45 to 55-1/2 feet requires an approved CU. The proposed <br /> project is supported within the General Land Use and Residential Area Goals and Policies section of <br /> the 2030 Comprehensive Plan. <br /> 2. The proposed use is not in conflict with any Regulating Maps or other adopted plan: The subject <br /> property in the northeast corner of County Road C and Lexington Avenue does not have a regulating <br /> plan, nor is there a small area plan or other that guides future development. <br /> 3. The proposed use is not in conflict with any City Code requirements: The CU for increased height is <br /> only one step in the project design process. That said, the City has received the first set of plans that <br /> it will review against the Design Standards of the Residential Regulations Chapter of the City Code. <br /> As for building height, the proposal achieves compliance with all other applicable Code standards. <br /> 4. The proposed use will not create an excessive burden on parks, streets, and other public facilities: <br /> Although the use will increase the number of residents, it will not create any adverse or excessive <br /> impacts to parks, streets, or other public facilities. <br /> Page 1 of 3 <br />
