EXTRACT OF MINUTES OF MEETING <br /> OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> * * * * * * * * * * * * * * * * * <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br /> Roseville,County of Ramsey, Minnesota, was held on the 27th day of August, 2018 at 6:00 p.m. <br /> The following Council Members were present: McGehee, Willmus, Laliberte, Etten and Mayor Roe and <br /> none were absent. <br /> Council Member Etten introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 11531 <br /> A RESOLUTION APPROVING A DRIVE-THROUGH FACILITY AS A CONDITIONAL USE <br /> AT 2154 LEXINGTON AVENUE PURSUANT TO 1009.02.0 AND 1009.02.D.30 OF THE CITY <br /> CODE (PF18-010) <br /> WHEREAS Peak Investments LLC d.b.a Mudslingers MN, in conjunction with the property <br /> owner Roseville Crossing LLC, has submitted a valid application for approval of a drive-through facility <br /> as a conditional use at 2154 Lexington Avenue <br /> WHEREAS, the property at 2154 Lexington Avenue is assigned Ramsey County Parcel <br /> Identification Number 14-29-23-22-0016 and is legally described as: <br /> That part of the Northwest Quarter of Section 14, Township 29, Range 23, described as follows: <br /> Beginning at the Northwest corner of said Section 14, being the center of the intersection of <br /> County Road B and Lexington Avenue, thence in a Southerly direction and parallel with <br /> Lexington Avenue; a distance of 133 feet; thence in an Easterly direction and parallel with County <br /> Road B, a distance of 135.7 feet; thence in a Northerly direction and parallel to Lexington Avenue <br /> a distance of 133 feet to the center line of County Road B, a distance of 135.7 feet to the point of <br /> beginning, according to the United States Government survey thereof. <br /> Ramsey County, Minnesota <br /> WHEREAS, City Code §1009.02.0 establishes general standards and criteria that pertain to all <br /> conditional uses; and <br /> WHEREAS, §1009.02.D.12 establishes specific standards and criteria that pertain to all drive- <br /> through facilities; and <br /> WHEREAS, the Roseville Planning Commission held the public hearing regarding the proposed <br /> drive-through facility on August 1, 2018, voting 7-0 to recommend approval of the use content of the <br /> provided staff report, public input, and Planning Commission deliberation; and <br /> WHEREAS, the City Council has made the following findings regarding the general standards <br /> and criteria established in §1009.02.C: <br /> 1. While a drive-through facility doesn't appreciably advance the goals of the Comprehensive Plan <br /> aside from facilitating continued investment in a property, it does not conflict with the <br /> Comprehensive Plan because such facilities are routinely incorporated into common commercial <br /> uses like banks, pharmacies, and coffee shops. <br /> Page 1 of 3 <br />
