2. The proposed use is not in conflict with any Regulating Maps or other adopted plans because no <br /> such plans apply to the property. <br /> 3. The proposed drive-through facility would meet all applicable City Code requirements, and a <br /> conditional use approval can be rescinded if the approved use fails to comply with all applicable City <br /> Code requirements or any conditions of the approval. <br /> 4. The existing drive-through facility has not been observed to create an excessive burden on parks, <br /> streets, and other public facilities. <br /> 5. The existing drive-through facility has not demonstrated itself to be injurious to surrounding <br /> neighborhoods and has not appeared to negatively impact traffic, property values, and will not <br /> otherwise harm public health, safety, and general welfare. <br /> WHEREAS, the City Council has made the following findings regarding the general standards <br /> and criteria established in §1009.02.D.12: <br /> a. The facility has two drive-through lanes and service windows, and one of each faces a public street <br /> (i.e., Lexington Avenue). The site abuts Lexington Avenue and County Road B, however, and the <br /> Community Development Department, the Planning Commission, and the City Council all support <br /> the placement of this window and drive lane. <br /> b. Points of vehicular ingress and egress are located at least 61 feet from the Lexington Avenue and <br /> County Road B rights-of-way lines. <br /> c. Pursuant to the 2014 approval of the existing drive-through facility as an interim use, the approved <br /> site circulation plan has been implemented, and vehicle movements to, from, and within the site have <br /> not unduly interfered with or compromised the safety of pedestrians or cyclists. Queuing space has <br /> been adequate and has not interfered with on-site parking or circulation. <br /> d. The existing drive-through facility does not have speaker boxes. Should speaker boxes be added to <br /> the drive-through lanes in the future, the potential speaker box locations are more than 200 feet from <br /> the nearest residentially zoned property or property in residential use. <br /> e. The existing drive-through facility is integral to the primary building. <br /> f. Despite the existing design of the drive-through, a double-sided order system with lanes entering and <br /> exiting from both County Road B and Lexington Avenue, none of the lanes are located directly <br /> adjacent to a public street; therefore,the requirement to screen the drive-through facility from <br /> residential properties or public streets does not apply in this case. <br /> NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to approve the proposed by <br /> the Roseville City Council, to approve the proposed drive-through facility as a conditional use at 2154 <br /> Lexington Avenue. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Council Member <br /> Laliberte and upon vote being taken thereon, the following voted in favor: McGehee, Willmus, <br /> Laliberte, Etten and Mayor Roe; and none voted against. <br /> WHEREUPON said resolution was declared duly passed and adopted. <br /> Page 2 of 3 <br />
