He noted Mr. Freiham- <br /> mer and himself usually work behind the scenes to prepare the documents and <br /> work to get them recorded against all of the properties. <br /> Mayor Roe stated the language in the condition of the resolution is that "A Decla- <br /> ration for Maintenance of Stormwater Facilities shall be approved by the City At- <br /> torney and City Engineer and filed against the platted lots to ensure proper fund- <br /> ing and ongoing maintenance of shared storm water BMP's". He asked if that <br /> language is satisfactory or is the City being too specific in calling it a Declaration <br /> for Maintenance or should the City be more general at this point as to what it is <br /> but requiring it to be reviewed and filed or is the direction it is going will make <br /> this a declaration. <br /> Mr. Hartmann thought this works the way it is written and gives the City the lati- <br /> tude it needs to revise the document and get if fully executed and record it. <br /> Councilmember Etten stated number 4 of RCA Exhibit D, gives the City a mech- <br /> anism of timing. If it is not operating as designed and the developer is supposed <br /> to be showing it is operating, it gives the City a timeframe to notice them and al- <br /> lows the City to take action in how the City would collect the costs back from the <br /> property owner. He felt that gives the City the "teeth" that some people are inter- <br /> ested in and makes sense. <br /> Mayor Roe offered an opportunity for public comment, with no one coming for- <br /> ward. <br /> Etten moved, McGehee seconded, adoption of Resolution No. ?? (Attachment C) <br /> entitled, "A Resolution Approving the Midland Crest Final Plat with the two con- <br /> ditions as set out in the RCA(PF18-011)." <br /> Council Discussion <br /> Councilmember McGehee stated she voted against this in the first place but now <br /> that it is done, she will support this. <br /> Roll Call <br /> Ayes: Willmus, Laliberte, Etten, McGehee and Roe. <br /> Nays: None <br /> e. Discussion on the License Center Renovation Project <br /> Finance Director Chris Miller briefly highlighted this item as detailed in the RCA <br /> and related attachments dated October 8, 2018. <br />
