He noted Mr. Freiham- mer and himself usually work behind the scenes to prepare the documents and work to get them recorded against all of the properties. Mayor Roe stated the language in the condition of the resolution is that "A Decla- ration for Maintenance of Stormwater Facilities shall be approved by the City At- torney and City Engineer and filed against the platted lots to ensure proper fund- ing and ongoing maintenance of shared storm water BMP's". He asked if that language is satisfactory or is the City being too specific in calling it a Declaration for Maintenance or should the City be more general at this point as to what it is but requiring it to be reviewed and filed or is the direction it is going will make this a declaration. Mr. Hartmann thought this works the way it is written and gives the City the lati- tude it needs to revise the document and get if fully executed and record it. Councilmember Etten stated number 4 of RCA Exhibit D, gives the City a mech- anism of timing. If it is not operating as designed and the developer is supposed to be showing it is operating, it gives the City a timeframe to notice them and al- lows the City to take action in how the City would collect the costs back from the property owner. He felt that gives the City the "teeth" that some people are inter- ested in and makes sense. Mayor Roe offered an opportunity for public comment, with no one coming for- ward. Etten moved, McGehee seconded, adoption of Resolution No. ?? (Attachment C) entitled, "A Resolution Approving the Midland Crest Final Plat with the two con- ditions as set out in the RCA(PF18-011)." Council Discussion Councilmember McGehee stated she voted against this in the first place but now that it is done, she will support this. Roll Call Ayes: Willmus, Laliberte, Etten, McGehee and Roe.
