2 <br /> WHEREAS, after two weeks published and posted notice have been given as well as notice <br /> having been mailed to all affected property owners according to Minnesota Statutes, a public <br /> hearing was held on December 3, 2018 at which all persons interested in said vacations were <br /> given an opportunity to be heard; and <br /> WHEREAS, the Roseville City Council has determined that the vacations would be in the <br /> public interest; <br /> NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> ROSEVILLE, MINNESOTA: <br /> 1. That the City of Roseville hereby vacates the following easements, which lies within the <br /> following described real property: <br /> #1 - Roadway easement over all of Lot 2, Block 1, Cherrywood Pointe at <br /> Lexington,recorded as Document No. 4608274. <br /> #2 - Drainage and utility easement dedicated over the northerly, easterly, <br /> southerly, and westerly 12' of Lot 2, Block 1, Cherrywood Pointe at <br /> Lexington. <br /> #3 - Driveway easement and sidewalk easement recorded as Document No. <br /> 1482439. <br /> #4 - Underground utility easement recorded as Document No. 1897015. <br /> #5 - Easement for underground sewer mains, pipes and appurtenances <br /> recorded as Document No. 1522585. <br /> #6 - Underground utility easement recorded as Document No. 1907124. <br /> #7 - Easement for underground sewer mains, pipes and appurtenances <br /> recorded as Document No. 1521403. <br /> #8 - Sewer easement recorded as Document No. 1517932. <br /> #9 - 20 foot wide sewer easement recorded as Document No. 1580419. <br /> #10 - 20 foot wide sewer easement recorded as Document No. 1504620. <br /> #11 - Storm sewer mains, pipes and appurtenances easement recorded as <br /> Document No. 1735913. <br /> 2. The vacations apply only to the right of way described in Provision 1 and not to: (a) the <br /> rights of existing utilities, if any, and (b) any other easements running to or benefiting the <br /> City of Roseville, if any. <br /> 3. The City Manager is directed to execute and record a Notice of Completion of this vacation <br /> proceeding pursuant to Minnesota Statutes §412.851. The vacations authorized by this <br /> Resolution shall not be effective until the Notice of Completion is recorded in the office of <br /> the Ramsey County Recorder. <br /> The motion was duly seconded by Councilmember Etten and upon vote being taken thereon, the <br /> following voted in favor thereof: McGehee,Willmus, Laliberte,Etten; and Roe and the following <br /> voted against: none. <br /> WHEREUPON said resolution was declared duly passed and adopted. <br />
