Regular City Council Meeting <br /> Monday,April 15, 2019 <br /> Page 6 <br /> coverage of the Neighborhood Enhancement Program to inspect approximately <br /> one-half of the properties within the City annually. <br /> Mayor Roe noted that he had highlighted this proposed change in his State of the <br /> City address earlier this year- as if it was already going to happen. <br /> Councilmember Willmus asked if the inspections would cover commercial prop- <br /> erties as well. <br /> Mr. Englund stated it would cover Commercial, Public and Multi-Family. <br /> Councilmember Etten stated he was a big fan of these proposed changes. <br /> Councilmember Laliberte indicated she was supportive of these two changes as <br /> well. <br /> Mr. Englund reviewed Limiting Outside Storage of Vehicles on Residential Prop- <br /> erty with the City Council. <br /> Councilmember Willmus stated the one thing that would give him pause with the <br /> stored vehicle language as written is a stored vehicle very realistically will go <br /> from the driveway to the street. He thought when this was discussed in Septem- <br /> ber that was one of the concerns he had because he did not want to move a prob- <br /> lem from one area to another. He would support the language with regard to the <br /> vehicle being used as a portable storage unit. He thought that made sense to him, <br /> but he struggled with some of the other aspects to it. <br /> Mayor Roe did not the think as the definition is written of stored vehicles, that it <br /> specifies it to be on the property and he did not know if that was intentional or if <br /> that was to allow the potential to regulate a vehicle stored on the City street in <br /> some fashion. <br /> Mr. Englund stated this was the closest he could come to defining a stored vehi- <br /> cle. He found one reference nationwide to this. <br /> City Attorney Gaughan stated his only reaction to this is the enforcement end of <br /> things. The scenario that comes to him is moving the vehicle back and forth from <br /> the driveway to the street and therefore outside of the regulation by having moved <br /> it. There is also the overcoming the burden of proof with the property owner. <br /> Councilmember Etten understood the City Attorney's points. He was not sure if <br /> this is the right way to police or not, but neighbors get frustrated when people <br /> have six or more vehicles stacked in a driveway and those cars never move. He <br /> did not know what the right answer is to this. He thought this is certainly a thing <br /> people have frustration with. <br />
