Guidelines state a fence cannot be built <br /> over the property line. <br /> Councilmember Etten stated there was a question about the timing for the pictures <br /> from this and wondered if there was a date for when the pictures were taken. <br /> Mr. Englund responded the pictures were taken April 10, 2019 and were noted. <br /> Councilmember Willmus stated from his perspective there are a couple of things <br /> at play. Certainly, this property owner has rights to use his property as he sees fit; <br /> however, that ceases when that use, his enjoyment of his property, affects the en- <br /> joyment of others. He did think it would be appropriate to give this property own- <br /> er some time on the order, perhaps two or three weeks, to delay action on staff <br /> recommendation of a Ramsey County court citation. He thought that was fair and <br /> gave Mr. Acree the opportunity to clean up that property. It also provided a reme- <br /> dy for those folks who are impacted by these things. He stated there are some <br /> pretty substantial items in the front yard. These are items that are not easily placed <br /> there and not items that are easily removed but nonetheless, are items that conflict <br /> with what the City has in Code. There is also a repeated pattern here that needs to <br /> be addressed moving forward. <br /> Willmus moved, Groff seconded, to direct Community Development staff to issue <br /> a Ramsey County Court Citation should the property not be in compliance by <br /> May 21, 2019. <br /> Council Discussion <br /> Councilmember Groff stated this is one of those situations that is very hard for <br /> everybody and seems to be unfortunate but everyone has to live together in the <br /> community and respect the neighbors on each side. Things need to be done to <br /> bring this into a standard and also in compliance with City Ordinances. <br /> Councilmember Laliberte echoed what Councilmember Willmus stated. She <br /> made the comment that this is unfortunately a repeated pattern and also unfortu- <br /> nate that the neighborhood is not able to enjoy each other. She thought a short pe- <br /> riod of time to try to get this remedied seems fair, but the process should not have <br /> to come back to the Council to get started, if needed. <br /> Councilmember Etten concurred with the comments that have been said. <br /> Mayor Roe concurred as well and wanted to be respectful of individual's rights <br /> and property rights on both sides of the fence, so to speak. <br /> Roll Call <br /> Ayes: Etten, Willmus, Laliberte, Groff and Roe. <br />
