He under- <br /> stands the City's position as well. <br /> Mayor Roe asked if the stack of landscape block along the property is being used <br /> as a fence. <br /> Mr. Acree stated that was correct. These are landscape blocks and very expensive. <br /> He has obtained a permit for this and it is being installed for privacy. He reported <br /> the fence does not touch his neighbors' fence. He noted the fence along his back- <br /> yard does have a tendency to lean a little due to the water that is back there, and <br /> he does not know where the water is from. He stated all of the cars in his yard are <br /> operable as well. He said he is willing to do whatever it takes to fix this situation. <br /> Mayor Roe asked if City Staff had a sense in terms of some of the Code issues re- <br /> lated to impervious coverage or planting or other treatment of properties. He un- <br /> derstood this was not being brought forward but wondered if staff had any sense <br /> to that on this property. <br /> Mr. Englund stated staff did do an impervious calculation on this property and not <br /> looking at any of the items, the property was at approximately 47% coverage, the <br /> allowable is 30%. There is a large pool and large patio so it is expected to be <br /> higher. He stated with using the items in the back, staff came up as impervious at <br /> about 83% coverage. <br /> Mayor Roe asked if because of perhaps the timing of knowing when coverage be- <br /> came impervious whether the City really has the ability to enforce or is that sort <br /> of a grandfathered in situation, and pre-existing condition. <br /> Mr. Englund stated that was brought to him when the calculation was done about <br /> how the City can offer a correction. There was some concern regarding the expan- <br /> sion of the driveway that occurred in 2017 that appears to be done not as de- <br /> scribed to the City. It was described as a repair to existing and in preparing this <br /> item, staff did find pictures that showed the area was previously a turf area along <br /> the fence and less of an addition to the driveway so there was added impervious at <br /> that time. <br /> Mayor Roe asked City Attorney Gaughan what the process is with the Ramsey <br /> County citation and what is anticipated moving forward if the Council authorizes <br /> this. <br /> City Attorney Gaughan stated if the Council authorizes the issuance of a Ramsey <br /> County District Criminal Citation it would go out as a summons to the property <br /> owner and the property owner would have a first appearance or arraignment ap- <br /> pearance followed by one pretrial appearance and then be set on a trial calendar. <br /> That could be expected to take nine months to a year to get to that point.
