Regular City Council Meeting <br /> Monday,June 3, 2019 <br /> Page 4 <br /> and even if the project zoning did not happen, the Council would have to do <br /> something if the Council wanted to go back from that. <br /> Mr. Paschke stated that is correct. <br /> Mayor Roe stated that is something that could be done, and the Council certainly <br /> could re-guide the property at that point if for some reason the project does not <br /> move forward. Despite the fact that affordable housing land use approval might <br /> require three votes, he imagined that if it was guided some other use, at that point, <br /> if this project did not go forward, it would require a four-fifth's vote. <br /> Mr. Paschke indicated that was correct. <br /> City Attorney Gaughan said that could potentially be the case. The City does <br /> have the Comprehensive Plan Amendment but then there would be a couple of <br /> different zoning classifications that the Council could go into without getting into <br /> another Comprehensive Plan Amendment. In theory that could require a super <br /> majority. He noted page three of five of the RCA has the actual suggested City <br /> Council action. He stated for Council consideration conditions three and four un- <br /> der the Conditional Use Resolution adoption were added. <br /> Mayor Roe stated the rezoning ordinance would not be published and made effec- <br /> tive until the City receives these plans and specifications. If the City determines <br /> the plans and specifications are not meeting City requirements the City would not <br /> publish the ordinance until the plans and specs were satisfactory. <br /> City Attorney Gaughan stated if the applicant wants this Conditional Use to in- <br /> crease density that is true. <br /> Mayor Roe thought the language might need to be adjusted to state, "on approval" <br /> rather than"on acceptance". <br /> City Attorney Gaughan reported staff would be working with the applicant on the <br /> final plans and specs so what is submitted will be acceptable to the City. <br /> Councilmember Etten asked if this meets all of the City's standard parking re- <br /> quirements or are there fewer parking spots because of the nature of the units. <br /> Mr. Paschke only spoke about the parking in the general sense because staff does <br /> not have final design plans, everything staff is currently looking at is conceptual. <br /> Whatever the unit count is and whatever the requirement for bedrooms or units in <br /> order to achieve compliance with the City Code would have to be provided in the <br /> site plan. The applicant could propose more but would have to achieve compli- <br /> ance with the minimum requirements. The applicant could also propose less and <br /> have that be provided in proof of parking that staff would review and make cer- <br />
