D. G&G Management LLC shall take no retaliatory actions against tenants for <br /> reporting in the past or in the future conditions of the Marion Street/The Brittanys <br /> Apartments to the City. <br /> E. G&G Management LLC upon revocation shall provide the current occupancy <br /> register to ensure compliance with condition F below and shall further give the City <br /> regular access to the occupancy register of the Marion Street/The Brittanys <br /> Apartments so that vacant units can be monitored by the City to ensure that no <br /> vacant units are rented during the time of the license revocation. <br /> F. G&G Management LLC shall display placards provided by the City on the exterior <br /> of each building of the Marion Street/The Brittanys Apartments, and upon each <br /> individual unit that becomes vacant, that states the multi-family rental license is <br /> revoked. <br /> G. Moving forward, G & G Management LLC shall employ a certified residential <br /> manager and certified residential maintenance technician through Minnesota Multi <br /> Housing Association, or an equivalent training and approved by City inspectors in <br /> accordance with City Code Licensing requirements provided in Section 908.03 (I) <br /> in order to restore and maintain the multifamily rental license issued by the City for <br /> the Marion Street/The Brittanys Apartments. <br /> H. The City Council may consider restoring the multi-family rental license for <br /> individual buildings if it is determined that all code violations for that building and <br /> units within it have been corrected and G &G Management LLC has demonstrated <br /> an ability to comply with City Code Section 908.07 by continuously complying <br /> with all applicable property maintenance, zoning health, building, nuisance, or <br /> other City Codes. Such request shall be made in accordance with Section 908.07 <br /> (G) (3), which entails new applications and payment of applicable fees. <br /> I. The City reserves the right to take additional legal action against G&G <br /> Management LLC, as provided in City Code Section 908.04 (D), if there is not <br /> sufficient timely progress in correcting the identified code violations. <br /> J. If other code violations are found in the Marion Street/The Brittanys Apartments <br /> while the multi-family rental license is revoked, they must also be corrected and <br /> G&G Management LLC is subject to the same conditions as contained in this <br /> resolution when correcting new code violations. <br /> BE IT FURTHER RESOLVED, G & G Management LLC, in accordance with City Code <br /> Section 908.08 has the right to appeal any licensing decision, including said revocation, as <br /> long as such appeal is submitted to the City within 30 calendar days after the making of <br /> the order or decision being appealed. Said appeal shall state the specific grounds upon <br /> which the appeal is made and the appeal is accompanied by the fee set forth in Chapter 314 <br /> of the City Code. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Member <br /> Etten, and upon a vote being taken thereon,the following voted in favor thereof: Laliberte, <br /> Etten, Willmus, Groff, and Roe and the following voted against: None. <br /> WHEREUPON said resolution was declared duly passed and adopted. <br />
