REQUEST FOR BOARD OF ADJUSTMENTSAND APPEALS ACTION <br />Date: April 20, 2020 <br />Item No: 7.c <br />Department Approval City Manager Approval <br />Item Description: Consideration of an appeal to the Board of Adjustments and Appeals pertaining to <br />determination of an unsafe building by the Building Official for property located at <br />2401 Prior Ave. N., Roseville, MN 55113. <br />1 B ACKGROUND <br />2 In July of 2017, the City of Roseville Fire Department (RVFD) was delegated Hotel / Motel inspections <br />3 from the State Fire Marshal’s office. <br />4 RVFD has conducted inspections at 2401 Prior Ave N. on November 7, 2017, August 10 & September 5, <br />5 2018, October 23 & December 2, 2019, February 20 and March 27, 2020. Each inspection noted violations <br />6 to State Fire Code, specifically concerns related to the condition of the fire suppression system (Attachment <br />7 A). <br />8 Correspondence from the Roseville Fire Marshal(RVFM), dated February 25, 2020, was sent to the <br />9 property owner whereby 30 days was providedto repair and return the fire sprinkler system for the entire <br />10 property to code compliant condition (Attachment B). The inspection was conducted on March 27, 2020 to <br />11 verify compliance, but failed due to continued inoperable fire suppression system (Attachment A). On <br />12 March 30, 2020, the RVFM send correspondence to the property stating the building is unsafe per <br />13 Minnesota State Fire Code Section 110.0 & 110.1.1. The RVFM also sent this correspondence to the <br />14 Roseville Building Official for further action under the Minnesota State Building Code (Attachment C). <br />15 Upon receipt of the determination of the RVFM, the Building Official drafted correspondence dated April <br />16 3, 2020, and hand delivered to the property and posted notices of Revocation of the Certificate of <br />17 Occupancy, condemnation of the building, structures and premises. Included in the posting was an order to <br />18 vacate no later than April 10, 2020 (Attachment D). <br />19 On April 6, 2020, the City Manager received contact from an attorney (Mr. McKenney) representing the <br />20 Norwood Inn and Suites regarding the revocation, condemnation and order to vacate(Attachment E). An <br />21 onsite meeting was requested by Mr. McKenney and conducted on April 9, 2020. The City Manager, <br />22 Building Official and Fire Inspector were in attendance representing the City. Hotel ownership, <br />23 management and contractor representatives were also in attendance representing the property. City staff <br />24 confirmed the propertystill did not have a fully functional fire suppression system and notification system <br />25 during this meeting. Staff was also advised it may be several weeks until such suppression system is fully <br />26 operable. During this meeting, City staff re-enforced that State Code requirements mandated the order to <br />27 vacate, subsequent an appeal of the determination of the Building Official. Staff also reminded ownership <br />28 and management that although the revocation was directly related to the inoperable fire suppression system, <br />29 there remains numerous unresolved violations to City and State codes.
