In the interim, staff imposed a mandatory Fire Watch 32 (Attachment F) to begin immediately and continue until such time as the fire suppression system ismade 33 fully operational or an approved appeal is granted by the Board of Appeals and Adjustments.A Fire Watch 34 is established under the Fire Code and requires human monitoring for smoke/fire due to the absence of an 35 operable fire suppression system. 36 On April 10, 2020, an appeal of the notice of an unsafe building determination was received by the City 37 Manager (Attachment G). Due to this appeal, the Building Official posted the property with a suspension of 38 the order to vacate, pending hearing by the Board of Appeals and Adjustments on April 20, 2020 39 (Attachment H). 40 S TAFF R ECOMMENDATION 41 Staff recommends that City Council deny the appeal by Perdin LLC (Norwood Inn & Suites), upholding the 42 revocation of the Certificate of Occupancy, condemnation and order to vacate the building, structures and 43 premises at 2401 Prior Ave. N., Roseville, MN 55113. This recommendation is based on the following: 44 The required fire suppression system is not fully operable, 45 The provisions of the Minnesota State Building and Fire Code applies, providing for 46 revocation of the Certificate of Occupancy, condemnation and order to vacate, and 47 The true intent and legally adopted rules have been correctly interpreted by the Building 48 Official. 49 50 If the decision is to deny the appeal, Council could stay the enforcement of the order to vacate until May 8, 51 2020 conditioned upon the following: 52 Requiring the continuation of the ordered Fire Watch 53 Requiring the installation of smoke detection devices (battery powered smoke alarms) 54 within the area of the structure not served by fire suppression or monitored smoke detection 55 Completion of work to have a fully functional and code compliant fire suppression system 56 and notification system for the entire premise within the stated time period. 57 If at the end of the stated time period the above conditions are not met, the order to vacate 58 will be enforced. 59 R EQUESTED B OARD OF A DJUSTMENTS AND A PPEALS A CTION 60 Decide on the appeal request made by Perdin LLC (Norwood Inn & Suites). 61 Prepared by: David Englund, Building Official 651-792-7087 david.englund@cityofroseville.com 62 Attachments: A: Correspondence dates and RVFD inspection reports 2401 Prior Ave. N.
