ATTACHMENT C <br />85 existing remedies of the jurisdiction or its officers or agencies relating to the removal or <br />86 demolition of any structure which is dangerous, unsafe and unsanitary. <br />87 5. Workmanship. Repairs, maintenance work, alterations or installations which are <br />88 caused directly or indirectly by the enforcement of this code shall be executed and <br />89 installed in a workmanlike manner and installed in accordance with themanufacturer’s <br />90 installation instructions. <br />91 6. Historic buildings. The provisions of this code shall not be mandatory for existing <br />92 buildings or structures designated as historic buildings when such buildings or structures <br />93 are judged by the code official to be safe and in the public interest of health, safety and <br />94 welfare. <br />95 7. Referencedcodes and standards.The codes and standards referenced in this code shall <br />96 be those that are listed in Section 906.10 Chapter 8 and in the current edition of the <br />97 Minnesota State Building Code, and, considered part of the requirements of this code to <br />98 the prescribed extent of each such reference. Where differences occur between <br />99 provisions of the current edition of the Minnesota State Building Code and the <br />100 referenced standards, the provisions of the current edition of the Minnesota State <br />101 Building Code shall apply. <br />102 Exceptions: <br />103 a. Where enforcement of a code provision would violate the conditions of the listing of <br />104 the equipment or appliance, the conditions of the listing shall apply. <br />105 b. Where conflicts occur between provisions of this code and the referenced <br />106 standards, the provisions of this code shall apply. <br />107 c. Where the extent of the reference to a referenced code or standard includes subject <br />108 matter that is within the scope of this code, the provisions of this code, as applicable, <br />109 shall take precedence over the provisions in the referenced code or standard. <br />110 8. Requirements not covered by code. Requirements necessary for the strength, stability <br />111 or proper operation of an existing fixture, structure or equipment, or for the public safety, <br />112 health and general welfare, not specifically covered by this code, shall be determined by <br />113 the code official. <br />114 9. Application of references. References to chapter or section numbers, or to provisions <br />115 not specifically identified by number, shall be construed to refer to such chapter, section <br />116 or provision of this code. <br />117 10. Other laws. The provisions of this code shall not be deemed to nullify any provisions of <br />118 local, state or federal law. <br />119 C. Property Maintenance Inspection <br />120 1. General. The department of property maintenance inspection is hereby created and the Building <br />121 Official shall be known as the code official. The Codes Coordinator shall be known as the code <br />122 official. <br />123 2. Appointment. The code official shall be appointed by the chief appointing authority of <br />124 the jurisdiction; and the code official shall not be removed from office except for cause <br />125 and after full opportunity to be heard on specific and relevant charges by and before the <br />126 appointing authority. <br />127 3. Deputies. In accordance with the prescribed procedures of this jurisdiction and with the <br />128 concurrence of the appointing authority, the code official shall have the authority to <br />129 appoint a deputy code official, other related technical officers, inspectors and other <br />130 employees.
