ATTACHMENT C <br />40 906.03: ADMINISTRATION <br />41 A. General <br />42 1. Title. Theseregulations contained in chapter 906 shall be known as the Building <br />43 Maintenance andPreservation Code of the City of Roseville, Minnesota, hereinafter <br />44 referred to as “this code.” <br />45 2. Scope. The provisions of this code shall apply to all existing residential and <br />46 nonresidential structures and all existing premises and constitute minimum <br />47 requirements and standards for premises, structures, equipment and facilities for light, <br />48 ventilation, space, heating, sanitation, protection from the elements, life safety, safety <br />49 from fire and other hazards, and for safe and sanitary maintenance; the responsibility of <br />50 owners, operators and occupants; the occupancy of existing structures and premises, <br />51 and for administration, enforcement and penalties. <br />52 3. Intent. This code shall be construed to secure its expressed intent, which is to ensure <br />53 public health, safety and welfare insofar as they are affected by the continued occupancy <br />54 and maintenance of structures and premises. Existing structures and premises that do not <br />55 comply with these provisions shall be altered or repaired to provide a minimum level of <br />56 health and safety as required herein. Repairs, alterations, additions to and change of <br />57 occupancy in existing buildings shall comply with the current edition of the Minnesota <br />58 State Building Code. <br />59 4. Severability. If a section, subsection, sentence, clause or phrase of this code is, for any <br />60 reason, held to be unconstitutional, such decision shall not affect the validity of the <br />61 remaining portions of this code. <br />62 B.Applicability <br />63 1. General. Where there is a conflict between a general requirement and a specific <br />64 requirement, the specific requirement shall govern. Where differences occur between <br />65 provisions of this code and the referenced standards, the provisions of this code shall <br />66 apply. The provisions of this code shall apply to all matters affecting or relating to <br />67 structures and premises, as set forth in Section 906.03.A. Where, in a specific case, <br />68 different sections of this code specify different requirements, the most restrictive shall <br />69 govern. <br />70 2. Maintenance. Equipment, systems, devices and safeguards required by this code or a <br />71 previous regulation or code under which the structure or premises was constructed, <br />72 altered or repaired shall be maintained in good working order. No owner, operator or <br />73 occupant shall cause any service, facility, equipment or utility which is required under <br />74 this section to be removed from or shut off from or discontinued for any occupied <br />75 dwelling, except for such temporary interruption as necessary while repairs or alterations <br />76 are in progress. The requirements of this code are not intended to provide the basis for <br />77 removal or abrogation of fire protection and safety systems and devices in existing <br />78 structures. Except as otherwise specified herein, the owner or the owner’s designated <br />79 agent shall be responsible for the maintenance of buildings, structures and premises. <br />80 3. Application of other codes.Repairs, additions or alterations to a structure, or changes <br />81 of occupancy, shall be done in accordance with the procedures and provisions of the <br />82 current edition of the Minnesota State Building Code. Nothing in this code shall be <br />83 construed to cancel, modify or set aside any provision of the International ZoningCode. <br />84 4.
