Unsafe equipment includes any boiler, heating equipment, elevator, <br />317 moving stairway, electrical wiring or device, flammable liquid containers or other <br />318 equipment on the premises or within the structure which is in such disrepair or condition <br />319 that such equipment is a hazard to life, health, property or safety of the public or <br />320 occupants of the premises or structure. <br />321 a. Structure unfit for human occupancy. A structure is unfit for human occupancy <br />322 whenever the code official finds that such structure is unsafe, unlawful or, because of <br />323 the degree to which the structure is in disrepair or lacks maintenance, is insanitary, <br />324 vermin or rat infested, contains filth and contamination, or lacks ventilation, <br />325 illumination, sanitary or heating facilities or other essential equipment required by this <br />326 code, or because the location of the structure constitutes a hazard to the occupants of <br />327 the structure or to the public. <br />328 b. Unlawful structure.An unlawful structure is one found in whole or in part to be <br />329 occupied by more persons than permitted under this code, or was erected, altered or <br />330 occupied contrary to law. <br />331 4. Dangerous structure or premises. For the purpose of this code, any structure or <br />332 premise that has any or all of the conditions or defects described as follows shall be <br />333 considered to be dangerous: <br />334 a. Any door, aisle, passageway, stairway, exit or other means of egress that does not <br />335 conform to the approved building or fire code of the jurisdiction as related to the <br />336 requirements for existing buildings. <br />337 b. The walking surface of any aisle, passageway, stairway, exit or other means of egress <br />338 is so warped, worn loose, torn or otherwise unsafe as to not provide safe and <br />339 adequate means of egress. <br />340 c. Any portion of a building, structure orappurtenance that has been damaged by fire, <br />341 earthquake, wind, flood, deterioration, neglect, abandonment, vandalism or by any <br />342 other cause to such an extent that it is likely to partially or completely collapse, or <br />343 to become detached or dislodged. <br />344 d. Any portion of a building, or any member, appurtenance or ornamentation on the <br />345 exterior thereof that is not of sufficient strength or stability, or is not so anchored, <br />346 attached or fastened in place so as to be capable of resisting natural or artificial <br />347 loads of one and one-half the original designed value. <br />348 e. The building or structure, or part of the building or structure, because of dilapidation, <br />349 deterioration, decay, faulty construction, the removal or movement of some <br />350 portion of the ground necessary for the support, or for any other reason, is likely to <br />351 partially or completely collapse, or some portion of the foundation or <br />352 underpinning of the building or structure is likely to fail or give way. <br />353 f. The building or structure, or any portion thereof, does not meet minimum standards for <br />354 its continued use and occupancy. <br />355 g. The building or structure is neglected, damaged, dilapidated, unsecured or abandoned <br />356 so as to become an attractive nuisance to people or persons who might enterthe <br />357 building, structure or premisesto their danger, or enables persons to resort to the <br />358 building or structure for committing a nuisance or an unlawful act or acts. <br />8 <br /> <br /> <br /> <br />
