ATTACHMENT C <br />269 2. Form. Such notice prescribed in Section 906.03.G.1. shall be in accordance with all of <br />270 the following: <br />271 a.Be in writing.; <br />272 b. Include a description of the real estate sufficient for identification.; <br />273 c. Include a statement of the violation or violations and why the notice is being issued.; <br />274 d. Include a correction order allowing a reasonable time to make the repairs and <br />275 improvements required to bring the dwelling unit or structure into compliance with <br />276 the provisions of this code. <br />277 e.Inform the property owner of the right to appeal. <br />278 f. Include a statement of the right to file a lien in accordance with Section 906.03.F.3. <br />279 3.Right to file appeal, right to file lien.If compliance is not achieved within the reasonable time <br />280 frame provided in the correction order, a statement of the right to appeal the order in accordance <br />281 with Section 906.03.K and the right of the City to file a lien in accordance with Section <br />282 906.03.F.3will be provided in a subsequent notice. <br />283 4. Method of service. Such Any notice prescribed under Section 906.03.G shall be deemed to be <br />284 properly served if a copy thereof is: <br />285 a. Delivered personally; or <br />286 b. Sent by certified or first-class mail addressed to the last known address; or <br />287 c. If the notice is returned showing that the letter was not delivered, a copy thereof shall <br />288 be Pposted in a conspicuous place in, on or about the structure, site or premises <br />289 affected by such notice. <br />290 5. Unauthorized tampering. Signs, tags or seals posted or affixed by the code official <br />291 shall not be mutilated, destroyed or tampered with, or removed without authorization <br />292 from the code official. <br />293 6. Penalties. Penalties for noncompliance with orders and notices shall be as set forth <br />294 in Section 906.03.F.4. <br />295 7. Transfer of ownership. It shall be unlawful for the owner of any dwelling unit or <br />296 structure who has received a compliance order or upon whom a notice of violation has <br />297 been served to sell, transfer, mortgage, lease or otherwise dispose of such dwelling unit <br />298 or structure to another until the provisions of the compliance order or notice of violation <br />299 have been complied with, or until such owner shall first furnish the grantee, transferee, <br />300 mortgagee or lessee a true copy of any compliance order or notice of violation issued by <br />301 the code official and shall furnish to the code official a signed and notarized statement <br />302 from the grantee, transferee, mortgagee or lessee, acknowledging the receipt of such <br />303 compliance order or notice of violation and fully accepting the responsibility without <br />304 condition for making the corrections or repairs required by such compliance order or <br />305 notice of violation. <br />306 H. Unsafe Structures andEquipment <br />307 1. General. When a structure or equipment is found by the code officialto be unsafe, or <br />308 when a structure is found unfit for human occupancy, or is found unlawful, such <br />309 structure shall be condemned pursuant to the provisions of this code. <br />310 2. Unsafe structures. An unsafe structure is one that is found to be dangerous to the <br />311 life, health, property or safety of the public or the occupants of the structure by not <br />312 providing minimum safeguards to protect or warn occupants in the event of fire, or <br />313 because such structure contains unsafe equipment or is so damaged, decayed, <br />314 dilapidated, structurally unsafe or of such faulty construction or unstable foundation, <br />7 <br /> <br /> <br /> <br />
