On May 18, the City Council reviewed the proposal along with the public record and adopted <br />11 Resolution 11703 approving the proposed Subdivision Variance and Lexington Woods preliminary plat, <br />12 with the following conditions. <br />13 1.Pursuant to thecomments from Roseville’s Fire Department Chief, the applicant shall install a <br />14 fire hydrant at both ends of the proposed cul-de-sac street. <br />15 2. Pursuant to the memo from Public Works staff in Attachment Gof this RCA, the applicant shall: <br />16 a. Provide an 8-foot bitumous trail within the Lexington Avenue right-of-way along the <br />17 length of the plat and any land accepted for park dedication. <br />18 b. Dedicate the specified easments and additional public right-of-way. <br />19 c. Post signs along private street prohibiting on-street parking. <br />20 3. The applicant shall dedicate the identified park land, or cash in lieu of land totaling $80,000, in <br />21 accordance with the recommendation of the Parks and Recreation Commission and the following <br />22 advice of the City Attorney: <br />23 a. The City should seek to obtain an appropriate statement of liability protection by the <br />24 Minnesota Pollution Control Agency. <br />25 b. The City should engage a qualified consultant to assist with the due-diligence regarding <br />26 the conditions of the soils in the land area considered for park dedication and the <br />27 ramifications of using the land for public park purposes. <br />28 c. The City should accept park dedication of cash in lieu of land if prudent due diligence <br />29 leads the City to conclude that the land is not suitable for park dedication. <br />30 4. The applicant shall continue to communicate with the adjacent homeowners regarding their fence <br />31 needs and interests. <br />32 An excerpt of the May 18 City Council meeting minutes and a copy City Council Resolution 11703 are <br />33 included with this RCA as Attachment C. Pursuant to Condition 4, the applicant has continued their <br />34 discussions about fences with the adjacent homeowners; it will remain an ongoing process, though, <br />35 because specific fence needs might depend on how the tree removals impact the abutting properties. <br />36 Final Plat <br />37 Since May 18, Parks and Recreation Department staff engaged AET to conduct the due diligence <br />38 advised by the City Attorney and has made a determination regarding the suitability of the <br />39 recommended land for park dedication. The due diligence report and the Parks and Recreation <br />40 Department’s recommendation is included with this RCA as Attachment D <br />41 The proposed final plat, whichreflects the determination regarding park dedication and is otherwise <br />42 identical to the approved preliminary plat,isincluded with this RCA as Attachment E. The draft Public <br />43 Improvement Contract, which also reflects the determination regarding park dedication, is included as <br />44 Attachment G. While the Public Improvement Contract is normally presented to Council as a separate <br />45 action item, it has been incorporated herein as it is dependent on the park dedication recommendation. <br />46 Staff representing the Parks and Recreation Department and Public Works Department will be in <br />47 attendance at the June 22 City Council meeting to provide further information about these items. <br />48 Public Comment <br />49 As of the the time thie RCA was prepared, no additional comments from the public about the proposed <br />50 plat have been received by Planning Division staff. <br />7g RCA <br />Page 2 of 4 <br /> <br />
