The Contractor shall assure the City that adequate recyclable <br />materialprocessing capacity will be provided for City material <br />collected. The proposals must clearly specify the location(s) of its <br />materials recovery facility (MRF), or subcontractor's facility, <br />where material collected from the City will be delivered and / or <br />processed, and a copy of the Contractor's written agreement <br />with the MRF. The Contractor shall provide written notice to the <br />City at least 60 days in advance of any substantial change in these or <br />subsequent plans for receiving and processing recyclables collected <br />from the City. <br />Proposers shall arrange a tour of the designated MRF for the RFP <br />review committee. The tour shall occur before June 3, 2016. <br />Upon collection, the City's Contractor shall deliver the collected <br />recyclables to a recyclable material recovery facility (MRF), an end <br />market for sale or reuse, or to an intermediate collection center for <br />later delivery to a processing center or end market. It is unlawful for <br />any person to transport for disposal or to dispose of designated <br />recyclables in a mixed municipal solid waste disposal facility. <br />Contractor shall assure that all recyclables collected in the City are <br />not landfilled or incinerated except for process residuals as <br />designated in 4.34 or with written authorization from the City and the <br />Minnesota Pollution Control Agency. <br />7.02 Lack of Adequate Market Demand <br />If the Contractor determines that there is no market for a particular <br />recyclable material or that the market has become economically <br />unfeasible, the Contractor shall immediately give written notice to <br />the City. Said notice shall include information demonstrating the <br />effort the Contractor has made to find market sources, and the <br />financial information justifying the conclusion that the market is <br />economically unfeasible. Upon receipt of said notice, the Contractor <br />and the City shall have 30 days to attempt to find a feasible market. <br />During this period the Contractor shall continue to pick up the <br />particular recyclable material. <br />If the Contractor or the City is not able to find a market within 30 <br />days, the City has the option to: <br />a) Require the Contractor to continue to collect the particular <br />recyclable material. The Contractor is required to keep <br />accurate records of said fees and provide the City receipts of <br />payment. <br />29 <br />
