The following acts or omissions shall be considered a breach of the <br />Agreement: <br />a) Missed Curbside Collection: $50.00 per miss <br />For each missed collection above two misses per collection <br />day, to be assessed at the end of each collection month. A <br />missed collection would be defined as a report by a resident <br />that their material was out by 7:00 a.m. and the address did <br />not appear on the Contractor's conveyance sheet as a "Late <br />Set Out".. Also included in Missed Curbside Collection are <br />Partial Dumps. Partial Dumps would be defined as a report <br />by a resident that their recycling cart was not fully emptied, <br />and the recyclables were not over -packed into the cart. <br />b) Missed Walk Up Collection: $50.00 per miss <br />Missed collection address above two misses at that address in <br />any four consecutive collection weeks. <br />c) Missed Multi -Unit Dwelling Complex Collection: $100.00 <br />per miss <br />d) Partial Dumps: $50.00 per miss <br />Partial Dumps would be defined as a report by a resident that <br />their recycling cart was not fully emptied, and the recyclables <br />were not over -packed into the cart. <br />e) Throwing or Dropping Carts: $50.00 per incident <br />For each witnessed report of a driver throwing rather than <br />placing, the curbside recycling container or deliberately <br />dropping the container when the bottom of the container is <br />more than four feet above the ground. <br />f) Failure to Collect Material on a Block: $500.00 per <br />incident <br />For each incident of the Contractor failing to pick up material <br />on a block. A missed block is defined as one side of a street <br />between cross streets or an entire cul-de-sac where residents <br />from at least three households on that street report that they <br />had their material out before 7:00 a.m., the material was not <br />picked up, the recyclables were properly sorted, and the <br />addresses did not appear on the Contractor's conveyance <br />sheets as "Late Set Outs." <br />g) Failure to Collect an Entire Zone: $1,000 per incident <br />For each incident of failure to complete collection of a <br />collection zone on its designated day as defined in Exhibit A <br />when the Contractor has not received an extension of <br />35 <br />
