6 Insurance and Other Legal Requirements <br />6.1 Insurance <br />Insurance secured by the Contractor shall be issued by insurance companies acceptable to the <br />City and admitted in Minnesota. The insurance specified may be in a policy or policies of <br />insurance, primary or excess. Such insurance shall be in force on the date of execution of the <br />Contract and shall remain continuously in force for the duration of the Contract. <br />Contractor shall provide a Certificate of Insurance as proof of general liability coverage for <br />bodily injury or death in the amount specified by state law. The Certificate of Insurance shall <br />name the City as an additional insured and state that the Contractor's coverage shall be the <br />primary coverage in the event of a loss. <br />The Contractor shall also provide a Certificate of Vehicle Liability Insurance in the amount of at <br />least $1,000,000. <br />The Contractor shall further provide a Certificate of Professional Liability Insurance or Errors & <br />Omissions Insurance providing coverage for: <br />The claims that arise from the errors or omissions of the Contractor or its <br />subcontractors; and <br />2. The negligence or failure to render a professional service by the Contractor or its <br />subcontractors. <br />The insurance policy should provide coverage in the amount of $1,000,000 each occurrence and <br />$1,000,000 annual aggregate. The insurance policy must provide the protection stated for two <br />years after completion of the work. Acceptance of the insurance by the City shall not relieve, <br />limit, or decrease the liability of the Contractor. Any policy deductibles or retention shall be the <br />responsibility of the Contractor. The Contractor shall control any special or unusual hazards and <br />be responsible for any damages that result from those hazards. The City does not represent that <br />the insurance requirements are sufficient to protect the Contractor's interest or provide adequate <br />coverage. Evidence of coverage is to be provided on a City -approved Insurance Certificate. <br />Contractor agrees that it shall obtain and maintain environmental liability insurance in <br />compliance with local, state, and federal regulations for all matters related to in this Recycling <br />Services Contract. Contractor shall add the City as an additional insured under said insurance <br />policy(ies). The policy coverage shall include Environmental Impairment Liability. Contractor <br />shall provide the City with appropriate documentation of said environmental liability insurance <br />for verification upon written request from the City. Contractor further indemnifies the City, its <br />employees, agents, and licensees from all liability related to hazardous contamination/pollution <br />resulting from the acts of the City, its employees or agents. <br />A 30-day written notice is required if the policy is canceled, not renewed or materially changed. <br />RFP for City of Roseville Recycling Services .
