the principal dwelling unit, shall apply for a new ADU Occupancy Permit according to the 4386 <br />procedure established herein. In addition to receiving an ADU Occupancy Permit, the 4387 <br />property shall be in compliance with the City’s rental registration requirements. 4388 <br />i. Application: The owner of property on which an ADU is proposed shall file a permit 4389 <br />application by paying the fee set forth in Chapter 314 of this Code and submitting a 4390 <br />completed application form and supporting documents as set forth on the application 4391 <br />form. The Community Development Department will review the application to determine 4392 <br />whether the application is complete and the subject property is eligible to receive the 4393 <br />requested ADU permit. 4394 <br />ii. Notification: Upon the determination that a complete application has been submitted and 4395 <br />that the property is eligible to receive the requested ADU permit, property owners within 4396 <br />a radius of 100 feet shall be notified in writing by the Community Development 4397 <br />Department of the application and that they have 7 days in which to share comments or 4398 <br />concerns about the application before the Community Development Department issues 4399 <br />the permit. 4400 <br />iii. Conditions: The City may impose conditions on the issuance of an ADU permit. Such 4401 <br />conditions must be directly related to, and must bear a rough proportionality to, impacts 4402 <br />created by the ADU. 4403 <br />iv. Revocation: If a permitted ADU or the property for which an ADU permit has been 4404 <br />issued should fail to meet the requirements of the permit, and/or if a property for which 4405 <br />an ADU permit has been issued should become ineligible for such permit, the issued 4406 <br />ADU permit may be revoked upon the determination by the Community Development 4407 <br />Department that the noncompliance and/or ineligibility issue(s) cannot or have not been 4408 <br />resolved. If an ADU permit is revoked, occupation of the ADU by a person or persons 4409 <br />other than the family (as defined in §1001.10 of this Title) occupying the principal 4410 <br />dwelling unit shall cease within 60 days of the date of the revocation. 4411 <br />v. Appeals: Determinations pertaining to the continuing compliance and/or eligibility of an 4412 <br />ADU permit or the property for which an ADU permit has been issued are subject to 4413 <br />appeal according to the procedure for appeals of administrative decisions established in 4414 <br />Section 1009.08 of this Title. 4415 <br />vi. Expiration: An ADU permit shall expire upon transfer of the property to a new owner. 4416 <br />Continued use of an ADU on a property which has been transferred to a new owner shall 4417 <br />require the new owner to apply for a new ADU permit. 4418 <br />2. Garden Sheds in LDR and LMDR Districts: Garden sheds may be built and/or sided with 4419 <br />materials which are different in character from the principal structure, but acceptable materials 4420 <br />shall not include galvanized or corrugated metal. 4421 <br />3. Home Occupation: Home occupations are allowed in residential districts, subject to the standards 4422 <br />below. 4423
