Staff <br />39 examined those tree preservation summary tables and is satisfied those were calculated correctly.As <br />40 such, the mistake with 3056 Hamline Avenue appears to be an anomaly. <br />41 Should the Council be interested in lowering the 10% fair market value cap, a public hearing before <br />42 the Planning Commission would be necessary. Decreasing the cash-in-lieu replacement fee in the City <br />43 Fee Schedule only requires a City Council action. Lastly, the City Council may elect to do nothing, <br />44 and if that is the consensus, staff would seek direction as to whether the variance process is appropriate <br />45 in the future to ensure staff is providing reasonable guidance to the public. <br />46 P OLICY O BJECTIVE <br />47 The City of Roseville recognizes that trees are a significant element of the community given their <br />48 beauty, their importance to the environment, and their positive impact on property values. The purpose <br />49 of Chapter 1011.04, Tree Preservation and Restoration, is to ensure trees are protected when they are <br />50 most vulnerable, establish reasonable requirements for replacement of trees lost due to development, <br />51 incentivize the protection and planting of trees at all times, institute plan requirements to ensure tree <br />52 loss can be identified prior to development, that adequate replacement plantings will occur following <br />53 land disturbances, and to provide for fair, effective, and consistent enforcement of tree preservation <br />54 requirements. <br />55 B UDGET I MPLICATIONS <br />56 The funds collected through the cash-in-lieu penalty must be spent in accordance with City Council <br />57 Resolution 11335 (Attachment B). To date, approximately $150,000 has been collected, namely from <br />58 two multi-family projects, but none of the funds have been expended. Community Development and <br />59 Parks & Recreation Department staff are working together to expend these funds on a future public <br />60 improvement project associated with management of Emerald Ash Borer. <br />61 S TAFF R ECOMMENDATION <br />62 Staff finds a cash-in-lieu fee for tree preservation and restoration of over $10,000 on a single family <br />63 lot to be excessive. Because this situation has only occurred once since the ordinance was adopted in <br />64 2015, the Council may elect to do nothingat this time. If so, staff seeks direction on whether the <br />65 variance process used is appropriate moving forward given it provides public notification, hearing and <br />66 appeal processes to protect the immediate public’s interests.
