The property has a Comprehensive Plan Land Use designation <br />14 of LowDensity Residential (LR) and a Zoning Map classification of LowDensity Residential-1 <br />15(LDR-1) District. <br />16 The Whitcomb’s are seeking a variance from §1011.04.J.8 Replacement Tree Locations, to <br />17 permit reduced tree replacement and seek relief from the required fee for not being able to plant <br />18 the replacement tree amount. This Code section reads as follows: <br />19 8.Replacement TreeLocations: Required replacement trees shallbe planted onthesite <br />20 being developed unlessdoingsoisdeemed tobeimpractical(i.e., due to lackofspace), <br />21 inappropriate(available planting areas arenotidealfor new plantings or would do little <br />22 to enhance thesite), or counterproductivetoa property’s intent(i.e., would entail too <br />23 much screening fora retail business)asdetermined bytheCityForester or other degreed <br />24 forester or certified arboristasassigned bythe CommunityDevelopment Department. <br />25 Whensucha determination ismade, theapplicantshallcomplywith replacement <br />26 requirements in one ofthreeways in the followingmanner: <br />27 a.As directed by the City, required replacement trees may be located on private <br />28 property within 1000 feet of the subject development site with the consent of the <br />29 property owner(s), on public improvement project sites that are not greater than 1000 <br />30 feet from the development site, or on other public and private lands that are not <br />31 greater than 1000 feet from the development site if such lands are deemed to be <br />32 available, with priority given to locations near the affected use; or <br />PF19-013_RVBA_907Burke_071019 <br />Page 1 of 4 <br /> <br />
