<br />respect to overpayments and erroneous payments shall be limited to fulfilling the obligations <br />described in this Section II.B. <br />C. Nondiscrimination testing. Based upon information supplied by Employer and upon written <br />request each Plan year, MEDSURETY shall run only the following nondiscrimination tests, if <br />applicable to the Plan under the Code: the cafeteria plan 25% concentration test, the dependent <br />care plan 25% concentration test, and the dependent care plan 55% average benefits test. <br />MEDSURETY shall communicate the results of such tests, and recommendations for correcting <br />any failed test, to Employer in writing. Employer shall be responsible for ensuring compliance <br />with all applicable nondiscrimination requirements related to such tests and any other test. <br />D. Participant Statements. On at least a quarterly basis, MEDSURETY shall provide to each <br />Participant who is participating in the medical expense reimbursement (health FSA) or the <br />dependent care expense reimbursement (DCAP) components of the Plan and has provided a valid <br />email address, an email providing information regarding account balances and claims paid. <br />E. Reports. MEDSURETY shall provide Plan Administrator with accountings of payments made by <br />MEDSURETY with respect to the Plan as described herein. MEDSURETY shall post standard <br />reports on its website on a monthly basis and shall notify Plan Administrator of the availability of <br />such reports. In addition, Plan information shall be available to Plan Administrator on demand <br />through MEDSURETYMEDSURETY shall also provide ad hoc reports upon Plan <br />Administratorrequest. <br />F. Debit Card Services. If Employer has elected to make debit cards available under the health FSA <br />and/or DCAP, MEDSURETY will provide the following services with respect to the debit cards: <br />1. Obtain all information necessary for issuance of debit cards to Participants. MEDSURETY <br />is entitled to rely upon the accuracy and completeness of all information provided by <br />Employer. <br />2. Through its subcontractor, issue debit cards and process debit card transactions. <br />3. Provide communications to Employer, Plan Administrator, and Participants regarding use <br />of debit cards. <br />4. Provide substantiation of expenses paid with the debit card that are not automatically <br />substantiated in accordance with applicable IRS rules. <br />5. Assist Plan Administrator with recouping improper debit card payments to the extent <br />required by IRS rules. Notwithstanding the foregoing, it shall be Plan Admi <br />ultimate responsibility for recouping such payments in accordance with applicable IRS <br />rules. <br />Notwithstanding anything herein to the contrary, if Employer fails to perform its obligations <br />described in Section III.C.1 below, MEDSURETY may immediately, upon notice to Employer, <br />suspend all services related to debit cards and shut off all debit cards issued under the Plan. <br />III. Duties of Employer and Plan Administrator <br />A. Participant Information. Employer shall, in a mutually agreed format, provide MEDSURETY with a <br />listing of all persons participating in the Plan and their elections thereunder.
