<br />any change in Participant elections. MEDSURETY may rely on the most current information in its <br />possession regarding the participation and election of a Participant in paying claims and providing <br />other services under this Agreement, including but not limited to, nondiscrimination testing. <br />B. Election Changes. Employer shall process and determine the appropriateness of all requests by <br />Participants to change their elections under the Plan. <br />C. Claims Account. Employer shall provide funding for claim payments under the Plan (including <br />payments made by debit cards issued to Participants under the Plan, if applicable) as provided <br />herein. <br />1. Claims Account. Employer shall provide funding for claim payments under the Plan ( <br />including payments made by debit cards issued to Participants under the Plan, if <br />applicable) as provided herin. <br />Debit Cards. Debit card transactions shall be funded by MEDSURETY and then Employer <br />shall reimburse MEDSURETY for the payments made. MEDSURETY shall be authorized to <br />initiate ACH transfers from a bank account owned by Employer to an account owned by <br />the MEDSURETY. Each week, MEDSURETY will transfer funds from such Employer <br />account to the MEDSURETYS account in an amount necessary to reimburse the debit <br />card provider for the debit card payments made under the Plan during that week. <br />Employer agrees to maintain sufficient funds in its account to cover the transfers to debit <br />t. In the event MEDSURETYs attempt to transfer funds from <br /> Employer shall pay the <br /> <br />2. Manual Claims. Claims Administrator shall establish the Claims Account. Employer <br />acknowledges that such account may include funds deposited by other employers for the <br />purpose of paying claims under benefit plans sponsored by such employers. Employer <br />further acknowledges that while funds are held in the account prior to reimbursement of <br />claims, MEDSURETY may earn bank credit and/or interest on such funds. Such bank <br />credit and interest shall be retained by MEDSURETY and be considered part of the <br />administrative fee paid by Employer to MEDSURETY for the services provided hereunder. <br />Employer shall provide Claims Administrator with authority to initiate transfers from an <br />account owned by Employer to the Claims Account or shall initiate such transfers itself <br />upon request of Claims Administrator. Claims Administrator shall notify Employer of the <br />dollar amount of each check run. Claims Administrator or Employer, as the case may be, <br />shall transfer funds to the Claims Account on the same day on which such notice is <br />provided. The amount of funds transferred to the Claims Account shall be sufficient to <br />permit the benefit payments under the Plan, but shall not exceed the amount of benefit <br />payments to be made under the Plan in Claims Admin so <br />transferred will remain subject to Employerwill be subject to the claim of <br />Employereditors, until paid by Claims Administrator to Participants. Employer may <br />request Claims Administrator to refund any of Employere Claims <br />Account <br />D. Nondiscrimination Testing. Except as specifically provided in Section II.C., Employer shall be <br />responsible for the nondiscrimination testing applicable to the Plan under the Code and for <br />iscrimination requirements. <br />E. Review of Reports.
